1. The City has received no new applications. I have h a short conversation
with a potential developer of a hotel who is investigating various properties
in the City. Similar in size /scope to the Americlnn.
2. Hollywood Video's neon signage is in disrepair, I have asked that it be
repaired or removed from the building.
City Hall Facilitv:
Enclosed are the meeting minutes for Construction Meeting #4.
The City has received the written report on the from Braun Intertec on the current
City hall Facility's possible asbestos levels in the roof. The report indicates that there
was no findings. At this point] will be preparing an abatement RFP to occur
immediately after the move to the new structure.
Meeting minutes from the Color Committee from 9/2/09. Final color sections /
patterns are to be presented to the City Council in the worksession targeted for
9/22/09.
OTHER ITEMS
• Washington County Board Agenda for September 15th, 2009 & Summary of
• Proceedings for September 1 st, 2009.
• 1 have executed the snow plowing contract for 2009 -2010 and have mailed
same to MJ Raleigh.
• The MET Council will be raising their wastewater charges by 3.8% for 2010
stating that it is necessary to implement such increases to make up for
shortfalls in SAC charges due to a downturn in new construction. This is a
noteworth policy shift as pervious Sewer Access Charges (SAC) were not set
high enough to pay for needed basic infrastructure such as trunk lines and
new treatment facilities. Now current utility rate payers will be paying more
for new wastewater infrastructure to make up for the shortfall demanded by
new development as opposed to operation and maintenance.
• The City has been provided an update from the Coalition of Utility Cities as
to the continuing discussion on the provision of Utility Transition Aid to the City
from the State of MN. Basically, the City is losing $360,000. The dispute is that
the Coalition does not believe that Dept of revenue Staff are applying the
statute correctly and that additional aid should be coming to the City. See
the enclosed email from Elizabeth Wefel.
• BCWD Meeting Agenda for 9/14/09
• SCADA system update from Chris Long of Bonestroo - with further staff
discussion it is hoped that the project can be done under $100,000 (not
including engineering) which will help from a budget perspective, but also
preclude the requirement of the preparation of a fill bid specification and
bidding process.

Dear Steve Johnson:
At this time it would appear the approximately one -half of your neon - lights have failed. You are
required to within the next thirty(30)days from the date of this letter repair these fixtures or
remove all the neon light structures from the facility. At this time, neon -light fixtures are prohibited
by City Ordinance, thus you may not install new fixtures, rather you may only repair what systems
are on the building.
At the end of the thirty days, the City will re- inspect this condition. Should these not be repaired
or removed from the facility, the City will be required to consider further action, which may
include the issuance of a citation for each day the condition remains in violation. This citation
may be issued t e manager or district managers or both as determined by the City.

1.4 General Construction Work
• Superintendent is now coordinating planning of Work in Mechanical /Electrical Room
(HVAC, Plumbing, Fire Protection and Electrical) to assure that all Work can be placed in
sequence, will fit and will be accessible for maintenance.
1.11 Miscellaneous Items
• Minnesota Pollution Control Agency follow -up review of General Contractor's onsite water
control is awaited. General Contractor received letter (Administrative Penalty Order) from
MPCA dated August 18, 2009. General Contractor may follow -up with MPCA. General
Contractor advised that payment will be made to MPCA this week.
• Architect will prepare and circulate (for signature) Special Testing and Inspection Form for
submittal to Municipal Building Official.
1.12 Architect's Comments
• Xcel Energy's Dwight Odegard was contacted regarding Xcel's request to have permanent
road to serve new Transformer that is located at building's northeast corner. Odegard was
asked to cite Xcel's written policy. Awaiting Xcel's response. City is discussing with Xcel.
Owner advised that Owner will install gravel pathway. Earth pile along east side of new
building must first be removed by General Contractor — General Contractor advised
that such removal is expected to occur mid- October.
• General Contractor must provide evidence that there is compliance with Buy American
provisions regarding structural steel. Information was received from General Contractor with
the exception of steel columns /tube sections. Information is awaited from General
Contractor.

3.8 Electrical Work

3.9 Geothermal Svstem
• New "split layout" is being prepared by Geotechnical Subcontractor and submitted. City
Council will review at its meeting of August 25, 2009. City Council approved "Split
Layout ". Awaiting updated Shop Drawings /Submittal from General Contractor.
3.13 Owner's Comme
• Owner will retain Consultant to prepare Bidding documents for Asbestos Abatement of
existing City Hall's roof. Consultant was retained.

• Architect met with Owner's Colors Selection Committee: Color Selections were made at
September 2, 2009 Meeting of the Colors Selection Committee. A Color Schedule will be
issued. Some Colors were not selected since General Contractor submittals are awaited
(i.e. wall pads, wood counter doors, lockers, signage, floor mats, rostrum in Council
Chamber and corner guards.
4.11 Miscellaneous Items
Questions from General Contractor:
• Disconnects are general duty not heavy duty; Architect will advise.
• Electrical devices will be white in color: Architect agrees.
• Does Pump Building require security conduit for card access? Architect agrees. Add to
project.
• Proposal Request Seven (Addition of electrical power and control wiring /cables from City
Hall to Well #2): Owner does not want controls (fiber optic cable).
• Can furring system at perimeter concrete block walls be 2" Z- channels in lieu of 1 iW' studs ?:
Architect agreed.
• Can UH -5 and UH -6 nits for Pump Building stay as specified and approved ?: Architect
agreed.
• Proposal Request Thirteen revisions are required: Architect will review.

4.13 Owner's Comments
• Owner wants to receive a letter from General Contractor that provides assurance that the
"Split System" will provide proper and necessary heating and cooling operations and will
function as intended and as represented to the City.
• Owner wants to upgrade or replace existing SCDA (water system monitoring). A meeting to
discuss that will occur on September 7, 2009.
• Fire Department exterior Key Box has been ordered.

Dear Mr. Johnson:
Braun Intertec Corporation (Braun Intertec) has collected eleven (11) bulk samples of roofing
material from the Oak Park Heights City Hall, located at 14168 Oak Park Blvd in Oak Park Heights,
Minnesota. The samples were analyzed for asbestos fiber content vid Polarized Light Microscopy
(PLM). Our representative collected the samples on September 2, 2009, at your request. This
report presents the results of our analysis.
Analytical Results
PLM analysis has resulted in no asbestos detected in any of the samples of roofing material from
the Oak Park Heights City Hall. Refer to the attached Table I. - Bulk Asbestos Analytical Results,
which lists the homogenous material sample numbers, sample locations, suspect material
descriptions, and the analysis results for each sample. Sample locations are depicted on the
attached Site Sampling Location Map.
Methodology
Bulk asbestos analysis was conducted in accordance with the Environmental Protection Agercy's
(EPA) Method 40 CFR, Part 763, Ch.1, Subpart F, Appendix A (7 -1 -87 Edition) and .EPA /600 /R-
93/116. All analyses are in compliance with the quality control procedures specified by the
methods. Each sample was examined for homogeneity. If a sample contained separate layered
components, each layer was analyzed separately. Detailed quality control information is available
upon request.
Remarks
Braun Intertec is accredited by the National Institute of Standards and Technology (NIST), National
Voluntary Laboratory Accreditation Program (NVLAP) for selected test methods for bull: asbestos
identification under Accreditation Number 1234. This report in no way constitutes or implies
♦ product certification, approval or endorsement by NVLAP or any ether agency of the U.S.
Government.

otherwise by the client.

2) Present were Judy Hoist and Jennifer Pinski (Oak Park Heights) plus Kate Dunwell and Randy Engel (Buetow).
3) Discussion at this Meeting included:
*Presentation of Color Boards by Interior Designer Kate Dunwell that depicted recommended color selections from
the Sorina Color Palette. Those recommendations were aDDroved ba the Colors Committee.
*Presentation of Floor Plans by Interior Designer Kate Dunwell that depicted recommended locations of paint
accent walls. Color selections were for such spaces as: Rotunda, Typical Office Areas, Council Chamber, Conference
Rooms, Restrooms and the Elevator Cab. Those Daint accent wall colors and locations were aDDroved by the Colors
Committee.
eThe following colors were newly selected and previous selections were confirmed: carpeting, rubber floor,
terrazzo tile, porcelain tile, vinyl base, acoustical ceiling tile, field paint colors, accent paint colors, countertop and
cabinet face materials (plastic laminate and solid surface material), toilet partitions, vinyl wall covering, acoustical
panels and horizontal louver window blinds.
*Plastic Laminate within the two Glass DiSDla Cabinets located at the entrance to the Council Chamber was selected.
•Wood Stain colors at doors, window interior surrounds, wood coiling shutters at main Reception Desks and at the
Council Chamber (interior doors, wood panel wainscoat, wood trim, face of Council Dais and custom color match of
moveable lectern /rostrum) to Council Dais.

*Perimeter Baseboard Radiation Covers will be painted in the field to match wall colors (a standard color is factory

Commissioner Resorts — Comments — Ouestions
The Commissioners reported on the following items:
- Commissioner Weik — attended the Metropolitan Mosquito Control meeting which discussed the
2010 budget; attended the Solid Waste Management Coordinating Board which discussed a new
recycling campaign; she met with Minnesota Department of Transportation Commissioner Tom
Sorel; and the Woodbury city -wide kickoff for the Yellow Ribbon Network will be held on
Monday, September 28 at the new East Ridge High School;
- Commissioner Kriesel, — attended the Solid Waste Management Coordinating Board, the
Community Corrections Advisory Board and the Disabled Veteran's Rest Camp Board; he met
with the Friends of Washington County which discussed the Boom Site and they are looking for
support to have the National Parks Service take ownership; and he commended the Sheriff's
Office for providing security and handling traffic concerns for Congresswoman Bachman's town
hall meeting at Oak -Land Junior High School;

- Commissioner Peterson — reported that the Metropolitan Mosquito Control has a surplus budget
and decided to invest in improvement of their facilities both environmentally and to enlarge

Met Council Adopts SAC Modifications and
3.8% Increase for 2010 MWC
On Wednesday, the Metropolitan Council adopted 2010 Municipal Wastewater Charges (MWC)
at a 3.8% increase, as well as formula changes for calculating SAC reserve capacity. The Council
also adopted our recommendation to establish a stakeholder task force to study the SAC system
and recommend options going forward.
As we reported previously, SAC revenues are seeing a sharp decline, and the Council was divided
about how to address the problem. Met Council's Environmental Services staff was asked to
present alternatives for Council consideration. The Council was reluctant to go too far in raising
the SAC charge, and members were also hesitant about dipping too deeply into the SAC reserve
fund. Staff came back with a proposal that alters the way SAC capacity is calculated to a flow -
based model that MCES staff contends provides technical improvements to the program. As part
of the proposal, MWC rates would need to be increased to help offset the decline in SAC
revenues. This is a funding shift that puts more of the burden for new SAC costs onto the
wastewater charge, which currently, for the most part, funds operations and maintenance costs of
the system.
The proposal quickly wound its way through Council channels, with the Council considering a
phase in of two or three years, which with a two year phase in would have put the 2010 MWC
increase at 5.1 %, a spike from the original 3.1 % increase provided to cities in June for their budget
planning purposes.
On Wednesday, the Council elected to move forward with the formula changes (moving to a
"flow" based system), with a three year phase in that increases the MWC charge 3.8 %, and the
creation of a task force, which we recommended. The Council's concurrence with our
recommendations for a longer phase in and task force will allow the opportunity to
comprehensively study the issues and consider options for the SAC fmancing structure. While we
appreciate the urgent need to address the SAC revenue decline, we are concerned about how
quickly these changes have proceeded, without adequate time to analyze the implications for cities
under the new structure. At the meeting on Wednesday, several Council members voiced similar
concerns, and the need to make sure that these formula changes are consistent with the Council's
policies around growth and maintenance costs.
In addition, the Council also adopted MCES' recommendation to alter the criteria for the SAC
outdoor seating charge to allow for a 75% reduction of these charges. This change will take effect
on October 1, 2009. Please stay tuned for further information on the task force. If you have any

Subject: CUC - UTVA Calculation Update
Dear CUC members,
We wanted to update you regarding our continuing conversations with the Department of Revenue regarding the
calculation of Utility Valuation Transition Aid.
As you may recall from our August 11, 2009 email, there are several possible explanations for why the utility transition aid
figures for 2010 are lower than originally anticipated: 1) A significant increase in the net tax capacity of the plants in
assessment year 2008 may have driven up utility values so as to make up for the decrease resulting from the rule change.
2) The "current year net tax capacity" used to calculate 2010 Aid is based on an assessment value that has phased in
50% of the new valuation rule. Our research -to -date shows that both of these factors are partially responsible for the
difference in certified utility transition aid.
1) With respect to the utility values, we are still trying to obtain numbers for all of our cities but comparing the net tax
capacity numbers for the utility facilities in several cities shows us that utility property values have increased significantly
(by about 7 — 9 %), particularly for cities with Xcel properties. Significant additions have come on -line at Oak Park Heights
(A.S. King) and two other XCel properties. Because utility property is valued as a unit, the increase at these three
facilities will increase the net tax capacity at all cities hosting Xcel plants, thereby decreasing the amount of UTVA.
2) Nick Greene, the research analyst responsible for the formula, is back in the office. We spoke with him this morning.
He confirmed that the Current Net Tax Capacity used to calculate the 2010 is the Pay 2009 value (2008 assessment), and
represents a 50% phased in value for the utility property. He explained that because of the timing of assessments,
property tax aids and credits (such as LGA and UTVA) are calculated with this "Look Back ". He also confirmed that
means for 2010, the aid may not fully reflect the loss in Net Tax Capacity experienced for 2010 but the cities would catch
up in later years.
This result does not appear to reflect the intent of the statute. The Utility Valuation Transition Aid was designed to
compensate cities for the loss in net tax capacity resulting from the rule change. In future years, the phase in will be
complete and the aid will more closely mirror this amount, but for 2010 the aid reflects only a portion of the net tax
capacity loss.
Our next step will be to meet with the Department of Revenue to determine what actions can be taken without pursuing
legislative change. Prior to that, we will meet with the House Research Department and Senate Counsel to discuss this
issue with them. We will also be enlisting the assistance Senator Skoe and Representative Marquardt, the chairs of the
Senate and House Property Tax Committees, as we move forward.

We have developed a schedule for the design and bidding process for the Water
System SCADA Improvements. The schedule is the result of on -site, internal, and city
council meetings.
As discussed at the staff meeting, because the construction costs are expected to be
under $100,000, this project will be issued using quotes rather than acquiring bids.
Two or more contractors will be chosen to provide quotes. The design for the
improvements has begun, and within two weeks a draft plan will be sent to Automatic
Systems Company for review to confirm the construction cost estimate. The milestone
dates are shown below:
