HomeMy WebLinkAbout2002-05-14 CC Resolution 02-05-27 RESOLUTION N O. 02 05-27 OF THE CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY APPLEBEE'S RESTAURANT FOR A SITE PLAN REVIEW FOR AN ENTRANCE VES11BULE AND A SIGN VARIANCE FOR PROPERTY AT 13625 60 STREET NORTH BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Applebee's Restaurant for a site plan review for an entrance vestibule and a sign variance to allow wall mounted signs on three different facades of the building located at 13625 60 Street North; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the application be approved with conditions. The City Council of the City of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and i 3. The subject property is zoned CBD, Central Business District in which restaurants are a listed permitted use; and 4. A sign variance is required to allow a wall mounted sign on a third facade of the building and overall wall signage that exceeds 100 square feet of sign area; and 5. The proposed 50 square foot vestibule requires site plan and building review under the Central Business District Design Guidelines; and 6. The City staff prepared a memorandum dated April 25, 2002 reviewing the request; and 7. The memorandum dated April 2S, 2002 recommended the request P q st be approved with conditions; and r_ 8. The Planning Commission held a public hearing at their May 9, 2002 meeting, took comments from the applicants and public, closed the public hearin , and recommended that the application be approved subject to conditions. NOW THEREFORE, BE IT RESOLVE] BY THE CITY COUNCIL FOR THE CITY OF OAK PARK ]HEIGHTS THAT THE CITY COUNCIL RECOMMENDS THE FOLLOWING: A. The application submitted by Applebee's Restaurant for a site plan review for an entrance vestibule and a sign variance to allow wall mounted signs on three different facades and overall wall signage that exceeds 100 square feet of sign area on a buildm' located at h g 1 3625 6 0 Street North; and affecting the real property as follows: SEE ATTAC HNffi A Be and the same as hereby approved by the City ouncil of the City of Oak P ` � y ark Heights for approval subject to the following conditions: 1. one additional wall mounted sign not to exceed 10 square feet and to be allowed on the east elevation of Applebee's Restaurant. 2. The sign shall be illuminated during regular business hours and must be turned off after 1:00 AM. 3. The neon sign shall not flash or rotate in any manner. 4. The two "to go" parking spaces will be p errm*tted. 5. Landscaping and screening shall be subject to the review and ap of the Ci tY Arborist.
