CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY OPH INVESTMENT LLP FOR A SIGN
'V'ARIANCE AT THE ARBY'S RESTAURANT AT
5990 NEAL AVENUE NORTH
SHOULD BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request fromMike -
Lawrence of Signcrafters, representing the owner, OPH Investments LLP for a sign variance to
add one reader board sign on the south wall of the Arby's restaurant at 5990 Neal Avenue; and
after having conducted a public hearing relative thereto, the Planning Commission 'of Oak Park
Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

and
2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

and
3. The property is subject to a conditional use pernut approved in 1998 to
allow the Arby's restaurant and drive through; and
4. In 1998, the City also granted a sign variance to allow for two wall sins
on the front building facade; and
5. The applicants have proposed a 32 square foot reader board sign with up
to four text lines on the south facade of the Arby's restaurant; and
6. The proposed szgnage exceeds the sxgnabe allowances specified under
Section 401.15.G of the Oak Park Heights Zoning Ordinance for numbers of signs allowed
within the B -2, General Business District; and
7 . City staff prepared a memorandum dated January 3., 2002 review ng the
request; and
8. The January 3, 2002 memorandum m recommended that the application for a
sign vanance to add one Treader board sign on the south wall of the Arbor's restaurant at 5990
Neal Avenue be approved with conditions; and
9. The Pl nn g Commission held a public hearing at their January 10, 2002
meeting, took comments from the applicants and public, closed the public hearing, and made the
following recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY of OAK PARK HEIGHTS THAT , rnE PLANNING
COMMISSION RECOMMENDS TRE FOLLOWING:
A. The variance application submitted by M e Lawrehee of Signcr rs for OPH
Investment LLP for additional si nage at the Arby's restaurant at 5990 Neal Avenue
North and affecting the real property as follows:

Be and the same as hereby recommended t the City Council of the City of Oa Park Heights for
approval subject to the following -conditions
I. one 111 rm ated reader board sign, not to exceed 32 square feet, shall be allowed on the
south elevation of the Arby's building.
