CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT ANA
RESOLUTION OF THE CITY COUNCIL TEAT THE
REQUEST BY OPH INVESTMENT LLP FOR A SIGN
VARIANCE AT THE ARBY'S RESTAURANT AT
5990 NEAL AVENUE NORTH
13E APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Mike
Lawrence of Signerafters, representing the owner, OPH Investments LLP for a sign variance to
add one reader board sign an the sough wall of the Arby's restaurant at 5990 Neal Avenue; and
after having conducted a public hearing relative thereto, the Planning Commission of Oak Park
Heights recommended that the application be approved subject to conditions. The City Council
of the City of Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

and
2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items;

and
3. The property is subject to a conditional use permit approved in 1998 to
allow the Arby's restaurant and drive through; and
4. In 1998, the City also granted a sign variance to allow for two wall signs
on the front building facade; and
S. The applicants have proposed a 32 square #'aot reader board sign with up
to four text lines an the south facade of the Arby's restaurant; and
6. The proposed signage exceeds the signage allowances specified under
Section 40 G of the Oak Park Heights Zoning Ordinance for numbers of signs and sign
square feet allowed within the B -2, General Business District; and
7 . City staff prepared a memorandum dated January 3, 2002 reviewing the
request; and
8. The January 3, 2002 memorandum recommended that the application for a
sign variance to add one reader board sign on the south gall of the Arty" s restaurant at 5990
Neal Avenue be approved with conditions; and
9. The Planning Concession held a public hearing at their January 10, 2002
meeting, took comments from the applicants and public, dosed the public hearing, and
recommended that the application be approved subject to conditions.
NOW, THEREFORE, `ORE, IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY of OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING;
A. The variance application submitted by mike Lawrence of Signrfters for OPH
Investment LLP for additional signage at the Arbor's restaurant at 5990 Neal Avenue
North and affecting the real property as follows:

That the City Council finds that the variance for one reader board sign is ustifia le in
that the building does not have a sign on the south facade and visibility of the existing
signage is not favorable from the south.
Be and the same as hereby approved by the City Council of the City of Oak Park Heights for
approval subject to the following conditions:
1. One illuminated reader board sign, not to exceed 32 square feet, shall be allowed on the
south elevation of the Arbor's building,
2. Any other conditions of the Planning Commission, City Council and City staf.
