RE: Allphase Report
Dear Mr. Bahr,
This morning 1 have had an opportunity to review the report submitted by Allphase Companies,
Inc as it relates to potential oil contamination (VOCs) in specific areas on your property as
recalled by persons living adjacent to the property.
Based on the results and commentary contained within the report it appears that, in those three
specific areas as tested, thete are not material indicators of contamination due to oil dumping or
land spreading of petroleum products. The Allphase report does however state that some
additional lab testing will be performed for diesel and gasoline. The Qity will need to receive a
copy of this report and will not issue an occupancy permit until this report is submitted and it
indicates that no material defects have been found. Please process such lab results as soon as
possible so that you are not delayed. If a material defect(s) is found you will be required to correct
such conditions prior to the issuance of an occupancy permit. So proceeding prior to these lab
results is at your own risk.
Once the City receives a copy of Allphase ;s current insurance declarations, the City will authorize
the release of the necessary building permits (assuming all other documentation is submitted to
the Building Official) so that you may move forward with basement, utility trenching and/or other
excavations on the site. However, the City does still require that an appropriate licensed
environmental technician from Allphase Inc. (or other firm subject to City approval) by on site at
all times and evaluating the site conditions as the property is being excavated. Please directly
refer to the conditions of your Conditional Use Permit and my letter dated August 14 X004 a
copy is again attached hereto.
Lastly, the other conditions of my August 14 letter remain in effect and will be criteria for "stop
work orders" should such items not be followed.

There have been some concerns raised by the local community relative to your pending project.
Namely, the City has received: reports of operations occurring in the middle of night and that
there has been excavation on the where soils were removed and new fill brought back in that may
have been in excess of slab removal.
Considering these items and following our conversation Friday morning and evening, the City
will require the following to be completed.
1. No excavation, demolition or earthwork of any kind may be undertaken unless supervised
by a licensed environmental specialist. The City must first approve such specialist.
2. A licensed environmental specialist shall perform the necessary investigation, including
taking soil samples, from the 3 area locations as marked upon the site by the City. Prior
to the issuance of a Building Permit, a report shall be prepared that provides an analysis
of any detrimental findings. If no such conditions are found the specialist shall provide a
report to the City that no such conditions were found.
3. A licensed environmental specialist shall perform the necessary investigation, including
taking appropriate soil samples, from the property during and earth moving activities
and/or for the excavation of the footings, foundations and service utility laterals. A report
shall be prepared that provides an analysis of any detrimental findings. Hilo such
conditions exist the specialist shall provide a report that no such conditions were found.
4. Should detrimental conditions be found under items 2 and/or 3 above or in other areas, all
further work shall cease and the environmental specialist shall immediately notify the
City, recommend the appropriate a course of action to remediate such detrimental
condition(s) and coordinate with the Owner to correct such conditions. No further work
or construction of any kind will be permitted unless and until the City receives
documentation from the environmental specialist that no detrimental conditions were
found, or that all such conditions have been appropriately remediated.
5. The Owner shall post all permits, contact names and project timetables on an appropriate
temporary sign.
6 The Owner shall provide the City a $5,000 escrow -- via letter of credit or cash deposit
that will ensure that all required elements are complied with and that the home movement
is completed in a timely fashion.
7. The City recommends that that the Owner holds weekly meetings with neighborhood
persons that may have concerns on their project. The Owner shall attempt in good -faith
address any and all such reasonable concerns.
I realize that these requirements may appear burdensome, but are necessary to ensure that your project
succeeds in the long -term and maintains positive relationships with the local community. If these items are
tackled in a timely manner your project should not be unnecessarily delayed. I believe that your project
upon its completion will certainly be a positive asset to the area.

laboratory for Diesel Ranged Organics (DRO) and Gasoline Ranged Organics (G RO).

SUBJECT DESCRIPTION
The subject she Is currently a vacant lot that used to have a small automobile repair shop. .
The subject site is located in a residential area on the southeast corner ol`58` Street and Penrose Avenue North in Oak Park
Heights, Minnesota. The subject site is bordered by residential property.
