HomeMy WebLinkAbout2004-07-15 PC Recommending ResolutionA RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY RODNEY BAHR FOR A CONDITIONAL USE PERMIT TO ALLOW AN EXISTING DETACHED SINGLE FAMILY HOME TO BE RELOCATED ONTO A VACANT LOT AT 15431 58 STREET NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Rodney Bahr for a conditional use permit to allow an existing detached single family home to be relocated onto a vacant lot at 15431 58 Street North; and after having conducted a public hearing relative thereto, the Planning Commission of oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: follows, to wit: and and 3. The property is zoned R-1, Single Family Residential District. Section 401.15.) of the Zoning Ordinance requires that the relocation of any building or structure over 120 square feet onto another lot within the City be subject to the review and approval of a conditional use permit; and request; and SEE ATTACHMENT B 4. City staff prepared a planning report dated July 8, 2004 reviewing the 5. Said report recommended approval of the conditional use permit subject to the fulfillment of conditions; and 6. The Planning Commission held a public hearing at their July 15, 2004 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by Rodney Bahr for a conditional use permit to allow an existing detached single family home to be relocated onto a vacant lot at 15431 58 Street North; and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby recommended to the City Council of the City of Oak Park Heights for approval subject to the following conditions: 1. Upon relocation, the building shall comply with the applicable requirements of the Uniform Building Code subject to approval of the City's Building Inspector. 2. A performance security is provided to the City as specified in Section 401.08 of the Zoning Ordinance. 3. The relocated structure is ready for occupancy within eight months from the date of location on the site. 4. A site plan showing landscape improvements approved by the City Arborist. 5. Approval of a grading and drainage plan by the City Engineer. 6. Revised building plans showing garage door access as matching submitted site plans. 7. Any required State environmental permitting for the site shall be obtained by the applicant and written copies provided to the City within ten days of receipt. 8. Applicant shall secure a licensed environmental specialist, subject to the approval of the City Engineer, to be on site at all times during the excavation phase of the construction and shall monitor the excavation activities to ensure that there are not findings of inappropriate buried materials and/or tanks. Should any inappropriate materials be found while the excavation is taking place, all work shall cease and the City shall be immediately notified. Upon completion of the excavation activities, the specialist will provide written comments to the City that no inappropriate, inconsistent or hazardous materials were found. 2 Recommended by the Planning Commission of the City of Oak Park Heights this 15th day of July 2004. Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the conditional use permit shall become null and void twelve (12) months after the date of approval, unless the property owner or applicant has substantially started the construction of any building, structure, addition or alteration, or use requested as part of the conditional use. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval.
