HomeMy WebLinkAbout2009-102-02 CITY OF OAK PARK HEIGHTS • WASHINGTON COUNTY, MINNESOTA ORDINANCE NO. 2009 -102 - AN ORDINANCE AMENDING CHAPTER 102 CODE OF ORDINANCES OF THE CITY OF OAK PARK HEIGHTS SPECIFICALLY RELATED FEE CHANGES THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, DOES ORDAIN: Section 1. Amendment. That Chapter 102 of the Code of Ordinances of the City of Oak Park Heights is hereby amended to add the following changes in fees, providing as follows: Schedule of Fee Amendments: • Water Usage Rates (Quarterly): As approved by City Council on 05 -26 -09 Up to 15,00 gallons from $26.24.10 to $28.31 + Each 1,000 gal. over 15,000 gal. up to 50,000 gal. from $1.78 to $1.96 • + Each 1,000 gal. over 50,000 gal. up to 99,000 gal. from $2.44 to $2.68 + Each 1,000 gal. over 99,000 gal. from $2.94 to $3.23 • Sewer Usage Rates (Quarterly): As approved by City Council on 05 -26 -09 Up to 15,00 gallons from $51.70 to $54.28 + Each 1,000 gal. over 15,000 gal. from $3.52 to $3.70 Section 2. Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication according to law. CITY HEIGHTS By: "'Beauiet, Mayor r Att t: Eri A: ohnson, City Administrator ORDINANCE NO. 2009 -401 -03 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA AN ORDINANCE AMENDING SECTION 401.15.G.8 (SPECIAL EVENTS) OF THE OAK PARK HEIGHTS ZONING ORDINANCE TO REVISE THE REQUIREMENTS FOR SPECIAL EVENTS IN THE DESTINATION RETAIL HIGHWAY DISTRICT THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, MINNESOTA ORDAINS: SECTION 1. Section 401.15.G.8.b, Number of Events of the Zoning Ordinance is hereby amended to read as follows: b. Number of Events. The business or applicant in all business and industrial zoning districts, as well as each public and institutional use in residential districts (except for the areas within the Destination Retail Highway District as indicated in Section 401.15.G.8.c), shall be allowed five (5) special events per calendar year. The total number of special • event days in a calendar year shall not exceed fifty (50) days for any applicant, business, or public and institutional use. Once the time period has expired for a special event the applicant shall wait the same number of days that the sign permit was issued to start a new special event. SECTION 2. Section 401.15.G.8.c, Events in the Destination Retail Highway District of the Zoning Ordinance is hereby added to read as follows: C. Events in the Destination Retail Highway District. The business or applicant in the Destination Retail Highway District shall be allowed twelve (12) sales events per calendar year. The total number of special event days in a calendar year shall not exceed one hundred eighty (180) days for any applicant, business, or public and institutional use. Once the time period has expired for a special event, the applicant shall wait two (2) days before starting a new sales event. All other special event requirements, as found in Section 401.15.G.8 of this Ordinance, shall be adhered to within the Destination Retail Highway District. SECTION 3. Section 401.15.G.8.d.4) Permitted Signs and Displays, Banners of the Zoning Ordinance is hereby added to read as follows: • 4) Banners. a) Banners may be attached to poles, tents, and buildings, provided that are well secured and are prevented from being blown around uncontrollably by the wind. b) No more than two (2) banners shall be allowed, except for the areas within the Destination Retail Highway District in which no more than five (5) banners shall be allowed at any one (1) time. c) Individual banners shall not be larger than twenty -eight (28) square feet and the total of all the banners on site shall not exceed one hundred forty (140) square feet. The applicant may choose to do fewer banners that may exceed twenty - eight (28) square feet as long as the total size of the banners does not exceed one hundred forty (140) square feet. SECTION 4. This Ordinance shall be effective immediately upon its passage and publication. PASSED this 27 day of October 2009 by the City Council of the City of Oak Park Heights, Minnesota.
