Item 4: The Parks Commission should comment on the private and public trail and sidewalk system for the area. The Planning Commission recommended that the applicant provide a north /south trail connection west of Menards and extending north on the west side of the wetland to 6D Street. The location and construction of the trail shall be subject to review and approval of the City Engineer. Response: Replace Item 4 with the following conditions: Item 14: The determination of the location, installation and payment for a north /south connection trail west of Menard's and extending north of 58 Street shall be deferred until the city receives an application for the proposed development of any part of Outlot A. The eleven parking stalls on the concept plan for Phase 2 at the access drive to Krueger Lane shall not be permitted and shall be removed from the plan if required by the City Engineer. Response: A per direction given by the Planning Commission on recommendation of the City Engineer. The eleven parking stalls have been removed. Additionally have removed from the plan, per their recommendation, any access points directly into the parking fields, for either Phase 1 or Phase 2, off of the access drive to Krueger Lane. Refer to exhibits AS -1.0 dated November 27, 2007. Item 15: The applicant shall provide noise specifications for the trash compactor subject to the approval of the city. Response: Have attached a portion of the Tenants, design guideline, Best Buy's Quick Start Guide, which includes information "sound levels" for both the rooftop equipment and the compactor equipment. Furthermore, both types of equipments are installed behind masonry screen walls that may reduce the "sound levels" as per the attached guide. Item 16: The applicant shall revise the building cross sections to clearly show the screening of the roof mechanical units. The views shall be from Krueger Lane and Highway 36. Response: Refer to exhibit A -8.1 dated November 27, 2007. The exhibit demonstrates the effective screening of the highest and most visible unit is achieved from both of these points. WCL Associates. Response: Replace Item 17 with the following conditions: Item 20: Item 21: Response: We had prepared this exhibit depicting the effective screening from two points determined during pre Planning Commission Staff Hearing (Trail forward of Americlnn and intersection of Newell and Highway 36. Both of points are higher in elevation and located further from the condition than the referenced location as requested this letter. Westwood, utilizing handheld GPS devise, located the elevation for three reference points, of which two were utilized. Trail, near a fire hydrant, forward of Americlnn = 942' -0 ", trail at intersection of Krueger Lane and 60th Street = 928'0 ", and trail at SEC intersection of Newell and Highway 36 = 936' -0 ". The vivid or primary colors on the front building facade of the Phase 1 building shall be limited to five percent (5 %) of the total building wall area. The vivid or primary colors on the front building facade of the Phase 2 building shall be limited to five percent (5 %) of the total building wall area of that building, unless otherwise adjusted when Phase 2 is completed. Item 18: The applicant shall select one of three options for addressing the Menards sign issue: Response: Amend this to add a sentence as follows: "Developer shall comply with one of these options before site plan approval for Phase 2 is granted, " The Planning Commission recommends that the building elevations be revised at the south and west elevations, such that the red brick color extend into the vertical columns. The elevation plans shall be revised and are subject to City Council review and approval. Response: Refer to exhibit A-6.1 dated November 27, 2007. The exhibit depicts the location of where vertical columns of red brick color will be installed at both the south and west walls. The columns of color will of same materials as the horizontal elements below on same wall. The construction to be single wythe masonry as per exhibit A -8.0 dated November 27, 2007. The utility lines along 60" Street shall be removed as required by Section 1008 of the City Code and as specified in the development contract. Item 21 be deleted in its entirety, for the following reasons: The applicant believes the Planning Commission may be basing this condition on a misinterpretation of the application of Section 1 008 of the City Code to this project. In fact, Section 1 008 , which defines Facilities as a "tangible asset" providing service from a public utility, requires "undergrounding" of "facilities" only when a developer installs "new" Facilities or " a permanent extension" of existing Facilities. See Section 1008.040. Burial of existing Facilities can be required only after a public hearing noticed for that issue. See Section 1008.060. As far as we know, no such hearing has been conducted. The utility lines along 60 Street are existing "Facilities" within the meaning of the statute. Item 23: All building lighting shall be full cut off, shoe box style fixtures with lenses that are fully shielded. There shall be no flood lighting of building facades. Response: Replace Item 23 with following conditions: All building lighting shall be full cut off styled fixtures with lenses that are fully shielded. Fagade illumination of the building shall be permitted, as per submitted proposal, as approved by the City Council. item 29: Signage shall be limited to a total of three wall signs and one freestanding sign not to exceed a total of 585 square feet of sign area. Response: Item 29 does not distinguish between Phase 1 and future Phase(s), as such request it to be restated as follows: Item 30: Response: Item 30 be amended to delete reference to payment of connection fees, which have already been paid. Best Buy compactors and rooftop units conform to suggested Environmental Protection Agency guidelines for day and night residential standards. b. Best Buy rooftop mechanical units produce 58 dba at 15 feet from source. c. The Best Buy compactor produces less than 50 dba at 100 feet from source. d. FIRE AND HEALTH EMERGENCY PROGRAM: a. Best Buy's building has an insurance rating of a Highly Protected Risk (HPR). b. The building is fully protected with a monitored automatic sprinkler and fire alarm system. c. Best Buy has trained personnel for emergency procedures in fire, tornado, earthquake, cus tomer or employee accidents, bomb threats, robberies, etc. 7. TRUCK DELIVERIES: a. Receiving dock hours for local carriers are 5:00 am to 8:00 p.m., Monday through Friday. b. Two (2) warehouse tractor /trailer trucks per week, depending upon store volume. This is 80 %Io of the store merchandise. Trucks are scheduled in groups of 2 or 3 at a time. c. Security lighting operated by an energy management system is used at all entry /exits and remains on all night. b. Best Buy installs approved burglar and fire alarm systems and an early fire warning system for specified areas. These systems are connected to a 24 hour UL rated monitoring station and when required, with local police and/or fire departments. c. Best Buy has a Loss Prevention Department with a full -time staff to minimize shoplifting and theft. Best Buy's policy is prosecution of violators. d. Best Buy uses a check authorization system to minimize bad check passing. e. Best Buy maintains lighting for customer parking areas one hour after store closing. f. Best Buy maintains lighting for employee areas 2 hour after store closing. Site and building signage will also remain on during these 2 hours. g. Site Lighting: Lamps are Metal Halide with a minimum maintained illumination at ground surface is 7foot candles averaged over the parking lot with an average Uniformity Ratio of 4:1. Light pole are typically mounted on 32 "diameter by 24" high concrete bases to protect the pole. Metal Halide directional flood lighting mounted on parking lot poles at 18' above grade: (2) 1000 watt fixtures per pole. Front two poles have flood lights directed at the front of the building in order to provide 10 foot candles of light. a. Best Buy Mobile Installation is a service that supports the sales of mobile electronic products within the store. We provide consumers an immediate way to integrate the purchase of car audio, security and mobile entertainment products into their vehicles. b. Most tools used for installation work are manually or electrically operated. We do not use pneumatic power tools. c.
