Mr. Tuckner,
As we discussed on the phone y esterda y (10122) the Cit does need to have a response from y ou as to the
two fees. As I had indicated the followin are the sums: (Please see attached memo from Kath Widin,
Arborist)
1) Project escrow fee: $13,575
2) Tree Replacement fee $ 53750
Simpl not respondin to our letters will result in the Cit takin the necessar action to secure pa or
steps to revoke an permits y ou have to operate. It is m understandin that y ou have not y et received y our
occupanc permit, meanin the Cit has not si off on the project - which could mean y our propert
insurance is at risk. I assure y ou that these fees are paid b all projects and is a priorit for the Cit as we
are a "Tree Cit
You indicated to me that y ou ma not have, the dollars to make these pa especiall the escrow fee as
it could tic up y our resources for over a y ear perhaps lon as some trees ma not survive. As I stated to
y ou, the Cit will accept an unencumbered letter of credit from y our lender in lieu of such Escrow Fee,
This will not tie-up y our capital and y ou can earn the interest.
However, the tree replacement fee is not somethin that can be waived and must be paid b November 21,
2003.

I have reviewed the approved landscape plan for century Power and inspected the site
several times in late summer and fall to check for installation and compliance with the
approved plan. The installed landscaping varies from the plan in several ways: 1. no
trees were installed on the north or east sides of the building, 2, there are fewer trees
planted than indicated on the plan, 3. there are fewer shrubs planted than indicated on
the plan, and 4. there have been some species substitutions for shrubs. In my opinion,
the number and species of shrubs are fine. In a discussion with Mr. Tuckner in June, he
indicated that they would prefer to not plant trees on the north and east sides of the
building for visibility reasons. I told him that the trees would then need to be planted
elsewhere on the property or they would be added to the inches of trees to be replaced.
Because the number of trees actually installed on the site are fewer than originally
indicated on the landscape plan (27 versus 47), the required replacement inches have now
increased from 80 to 115. This changes the replacement requirement to 57, 2 in. trees or
$5,750. (cash in lieu of replacement, 115 in. x $50. /ia. ) . I have also inspected the
larger existing trees within the construction area. They are still alive at this time. A
performance security of $13,575. (1.5 x estimated replacement costs) is still due. The
final inspection of these trees will be in September of 2004, after which time the
performance security, minus any replacement costs for trees which have died or are in
severe decline, will be returned to the property owner. Please contact me if you have any
