I have no problems with holding their escrow. Is this in the ordinance as an option? If not does the Council have to
approve it?

I have had a request from the landscape architect/engineer /tree inspector
for the Century Power project to require Century Power to only pay tree
replacement for trees that have actually been removed at this time. There
are a number of trees in or near the construction area which are
"reasonably anticipated to be lost" (decline and die) as a result of the
construction; however, they are not dead yet. As per the tree protection
ordinance language, I included both groups of trees in my calculations. I
would be willing to wait and inspect the second group of trees this
summer, to determine if they are declining and/or dead, if there is some
way monies could be held in escrow to pay the tree replacement if they
die (similar to what is done to insure landscape installation). Could these
monies be held until Sept. 2004, since construction damage does not
always cause trees to die immediately? If this were allowed, Century
Power would then be required to pay approx. $4150. before Certif. of
Occupancy and approx. $8900. would be held. Please consider this and
let me know your thoughts this week. Thank you.
