HomeMy WebLinkAbout2002-06-25 CC Resolution #02-07-34follows, to wit: and and request; and RESOLUTION NO. 0 - OF THE CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FIlVDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY CENTURY POWER EQUIPMENT FOR A CONDITIONAL USE PERMIT, SITE PLAN, AND DESIGN GUIDELINE REVIEW TO ALLOW A BUILDING ADDITION AND SITE IMPROVEMENTS FOR PROPERTY AT 5920 MEMORIAL AVENUE NORTH BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak. Park Heights has received a request from Century Power Equipment for a conditional use permit, site plan, and Design Guideline review to allow a building addition and site improvements at 5920 Memorial Avenue North; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the application be approved with conditions. The City Council of the City of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B 3. The subject site is zoned B-3, Highway Business and Warehouse in which retail sales and service facilities are a permitted use. Conditional use permits are required for outdoor sales and to allow less than 20 percent of the buildable portion of the lot to remain as a lot with landscaping; and 4. The building addition and site changes require site plan and building review under the Design Guidelines; and 5. The City staff prepared a memorandum dated June 6, 2002 reviewing the 6. The memorandum dated June 6, 2002 recommended the request be approved with conditions; and 7. The Planning Commission held a public hearing at their June 13, 2002 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Century Power Equipment for a conditional use permit for outdoor sales and to allow less than 20 percent of the buildable portion of the lot to remain as a lot with landscaping, site plan, and Design Guideline review to allow a building addition and site improvements at 5920 Memorial Avenue North, and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject to the following conditions: 1. Outdoor sales items shall not be displayed in required parking stalls. All outdoor sales items must be placed on a concrete or asphalt surface. 2. Outdoor sales shall be limited to 20 percent of the interior retail sales area or 3,000 square feet. 3. Service vehicles shall be parked on the south side of the building and shall be properly screened by landscaping as approved by the City Arborist. 4. All repairs shall be conducted inside of the building. No parts storage or parts vehicles shall be stored outside of the building. 5. Any allowance for display of outdoor sales items in the yard or on the grass shall require application for a variance, as specified in Section 401.04 of the Zoning Ordinance. 6. The site plan has been revised to accommodate at least 115 parking stalls. Proof of parking stalls will be allowed, as provided for on the approved site plan. The City Council may order, at any time, the construction of the proof of parking stalls. 7. The 18 foot parking stalls length is adequate for the outside perimeter parking stalls on this site. 2 8 . The landscape plan and tree preservation plan shall be subject to review and approval of the City Council and City Arborist. 9. Screening of heating /air conditioning units, electrical transformers, air handling equipment, trash receptacles, and roof top equipment shall be required as part of the landscape plan and building plans, subject to review and approval of City staff. 10. The building plans have been revised to include additional vertical elements and building detailing, especially on the north and south facades. The plans are acceptable to the Planning Commission, and subject to review and approval of the City Council. 11. Building samples are acceptable to the Planning Commission and subject to review and approval of the City Council. 12. The lighting plans shall be revised and updated to include fixture elevations and photometrics that are compliant with Section 40 1.15.7 of the Zoning Ordinance. 13. No signage approval is granted with this application. An application for a sign variance will be required for moving the existing pylon sign. 14. The applicant shall submit a plan for site snow removal. 15. All grading, drainage, and utility plans shall be subject to review and approval of the City Engineer. 16. Browns Creek Watershed District approval of the plan is required. 17. The existing /proposed building shall be brought current with all building/fire codes as required by the Fire Marshal and Building Official. 2002. Site Development Plan, Dimension Plan, Grading Plan, Landscape Plan* *Please refer to zoning ordinance for detailed description. Lapse of Approval Unless the City Council specifically approves a different time when action is officially taken on the request, the conditional use permit shalt become null and void twelve ( months after the date of approval, unless the property owner or applicant has substantially started the construction of any building. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval. (401.03.7).
