HomeMy WebLinkAbout06-06-26 r RESOLUTION 06 -06 -26 RESOLUTION APPROVING DETACHMENT OF LAND FROM THE CITY OF OAK PARK HEIGHTS AND ANNEXATION TO THE CITY OF STILLWATER PURSUANT TO AGREEMENT WHEREAS, the City of Oak Park Heights agreed with Washington County and the City of Stillwater to the detachment of certain lands from the City of Oak Park Heights and annexation of the same to the City of Stillwater all pursuant to the agreement being dated October 4, 2005; and, WHEREAS, the October 4, 2005 agreement as provided also has the City of Oak Park Heights returning to the State of Minnesota its interest in and to certain tax forfeited lands, and otherwise agreeing to the detachment and annexation of those lands to the City of Stillwater in order to facilitate the County's future plans for development of its surrounding campus, both for the parking lot and building purposes all pursuant to the signed Agreement; and, • WHEREAS, the City Council for the City of Oak Park Heights has previously approved the agreement authorizing the detachment and annexation of lands to the City of Stillwater; and, WHEREAS, the City of Oak Park Heights hereby requests by this resolution the Department of Administration - Municipal Boundary Adjustments to detach a certain property described herein from the City of Oak Park Heights and make a part of the City of Stillwater as described in Attachment "A "; and, WHEREAS, the property is situated within the City of Oak Park Heights, abuts the municipal boundary of the City of Stillwater in the County of Washington. The petitioned area abuts the City of Stillwater's south and west boundary; and, WHEREAS, the property proposed for detachment is urban in character and will be developed to support the Washington County Government Center campus; and, WHEREAS, the number of acres in the property proposed for detachment is 17,430 square feet and is described as follows: SEE LEGAL DESCRIPTION (Attachment A) 1 0 WHEREAS, the reason detachment is requested is that the area is part of the f 1 • Washington County Government Center Campus which is in the City of Stillwater, the County Seat of Washington County; and, WHEREAS, the subject area may be utilized in accordance with the Agreement between the City of Oak Park Heights, the City of Stillwater and Washington County; and, WHEREAS, the number of residents in the proposed area is zero; and WHEREAS, there is one building on said property; and, WHEREAS, the subject property is predominately owned in fee by Washington County and as such, is exempt from the payment of real estate taxes; and, NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Oak Park Heights, Washington County, Minnesota that it hereby detaches the following legally described property (Attachment A) and allows it to be attached into the corporate limits of the City of Stillwater, Minnesota.
