CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ALLOWING GLADSTONE CONSTRUCTION, INC., TO WITHDARW
THEIR BID FOR UNILATERAL MISTAKE AND ERROR IN COMPUTATION
RELATIVE TO THE AUTUMN HILLS PARK SHELTER BIDS
WHEREAS, the City Administrator for the City of Oak Park Heights prepared and
published its specifications for the Autumn Hills Park Shelter which were forwarded to the public,
published and provided to contractors in the manner provided by law; and,
WHEREAS, the City received bids in response to the specifications for the
construction of the park shelter in the Autumn Hills park on Friday, June 30 2006; and,
WHEREAS, among the bidders presenting proposals and construction bids for the
facilities was Gladstone Construction, Inc.; and,
WHEREAS, Gladstone Construction, Inc. presented a bid for the base bid of
$275,960.00; and,
WHEREAS, on the following Monday, July 3rd, 2006, Gladstone Construction,
Inc. promptly notified the City that they had made an error internally in the computation of their bid
and requested permission to withdraw their bid relative to the Autumn Hills Park Shelter project;
• and,
WHEREAS, Gladstone Construction, Inc. has offered to pay the City of Oak Park
Heights the sum of $3,500.00 for the inconvenience to the city for the clerical error in the bid,
inconvenience to the City and expense in processing both their bid, as well as the request submitted
by them to withdraw for internal clerical error; and,
WHEREAS, the City of Oak Park Heights has not yet awarded any contract and is
willing to allow Gladstone Construction, Inc. to withdraw their bid upon payment of the sum of
$3,500.00.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Oak Park Heights that Gladstone Construction, Inc. is hereby allowed to withdraw their bid upon
their payment to the City of Oak Park Heights in the amount of $3,500.00.
