RE: TIF Application
Mr. Nolde,
The City is in receipt of your application for City Financial Assistance (TIF) and the required Application
Fee of $3,000. However, upon review of the submitted documentation the City at this time is rejecting
your application, deeming it to be incomplete. Accordingly the City is also returning your check ($3,000)
also to be resubmitted.
The following information, which we believe to be seminal to our City's ability to engage in a basic
analysis, must be provided with any resubmission:
A summary description of the project scope;
A detailed description of the proposed TIF project(s) — this must include type of TIF area
proposed, anticipated projects, timelines and an identification of what party is to be
responsible for each element;
A detailed survey map depicting the area to be included in the TIF District;
A parcel list that identifies each property owner and official legal descriptions of each
parcel within the district and a legal description of the total proposed district;
Mailing labels (as provided by Washington County) that identifies all property owners
within the proposed district and within 500 feet of its limits;
A detailed pro-forma analysis of the anticipated expenditures, revenues and proposed
financing methods - this analysis must be provided by a firm typically understood to be
able to provide such documentation (Ehlers, Springstead, Vierbeicher, etc.);
A written detailed analysis by your legal counsel that demonstrates and stipulates that the
proposed TIF district is (and shall be) in compliance with all statutory requirements for
its specific type of TIF use;
A written detailed analysis and distinct determination that the project would not be
possible without the usage of TIF, "the but-for test". This analysis must be provided by a
firm typically understood to be able to provide and testify to such statement;
Written analysis of the estimated benefits the TIE would bring to the City.
We would recommend that you engage a firm to prepare the above information, I had mentioned a few
firms above — the City has no preference.
Lastly, as you are aware the City has rejected the most recent Oakgreen Application as significant
information was missing from the documentation. However, the City does have some concerns on how this
TTF, wherever it may be located, is to be part of that development scenario in some fashion. Your TIF
submissions and Oakgreen Village submission should clearly state this relationship, if any.
We have a proposed a meeting date on the new Oakgreen Village Project for March 2, 2005 where this
resubmission will be discussed in detail with yourself and VSSA. Having your consultant from (Ehler's,
Springstread ?) participate in that discussion would be beneficial.

Application Review
The undersigned acknowledges that before this request can be considered and /or approved, all
required information and fees, including any deposits, must be paid to the City. An incomplete
application will be returned to the applicant. The application approval process commences and
an application is considered complete when all required information and fees are submitted
appropriately to the City.
Professional Fee Responsibility
It is the understanding of the undersigned that all City incurred professional fees and expenses
associated with the processing of this request(s) will be promptly paid upon receipt. If payment
is not received from the applicant, the property owner acknowledges and agrees to be
responsible for the unpaid fee balance either by direct payment or a special assessment
against the property.
Applicants will be billed on a monthly basis for Planning, Engineering, Legal and Community
Development fees as they are accrued. It is understood that interest will be charged on the
account at the maximum rate allowed by the Fair Credit Act if it becomes thirty (30) days past
due. Failure to pay administrative and processing fees in a timely manner may result in denial
of the application. All fees must be paid at the time of application and shall be paid prior to the
issuance of a building permit.
The undersigned applicant further acknowledges and consents that all unpaid fees owing the
City of Oak Park Heights shall be treated as unpaid utility fees and may be certified for
collection as with delinquent utility billings and may be assessed against the subject real
property if unpaid by October 31 of each year.

Dear Eric:
Please allow this letter to accompany our application for tax increment financing. My earlier setter to
the council stated, our intention to remove the homes along Oakgreen Avenue, thereby allowing for
the widening of Oakgreen, eliminating the run-down appearances of the properties, and providing a
continuing town home development in the area. We cannot accomplish these tasks without using this
form of financing. The cost of purchasing these homes exceeds the value of placing town home units
on those parcels.
Our proposal is for the "pay -as- you -go" form of TIE`, whereby the city is never financially obligated
towards the particular development.. I think_ once the council learns more about this process from the
consultants, they will feel more comfortable. Our choice of consultants is Ehlers and Associates;
however, it's your decision.
The final plans and other information required are being submitted with the March Planning
Commission material. Perhaps we can "jump- start' the process with this letter. With your help we
can make this area of the city tr iy compatible with the city's' long term planning and development
