HomeMy WebLinkAbout2004-05-13 PC Recommending ResolutionA RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY STILLWATER AUTO CLINIC FOR A CONDITIONAL USE PERMIT TO ALLOW FOR AUTO REPAIR USE IN THE B -3 DISTRICT AT 12430 55 T11 STREET NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Stillwater Auto Clinic for a conditional use permit to allow for auto repair use in the B -3 District at 12430 55"' Street North; and after having conducted a public hearing relative thereto, the Planning Commission of oak Park heights makes the following findings of fact: follows, to wit: and 1, The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: and SEE ATTACHMENT B 3. The subject site is zoned B -3, highway Business and Warehousing District in which auto repair use is a conditional use; and request; and 4. City staff prepared a planning report dated May f, 2004 reviewing the 5. Said report recommended approval of the conditional use permit subject to the fulfillment of conditions; and 6. The Planning Commission held a public hearing at their May 13, 2004 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. All automobile repair activities shall be limited to within the principal structure and the doors to the service ba shall be kept closed except when vehicles are bein moved in or out of service areas. 2. There shall be no exterior stora of autornobile parts, parked cars, or related items on the site. All stora shall be internal to the buildin An cars to be stored outside of the buildin shall be in full work-In order. 3. All noise created from operations on the site shall be in conformance with Section 401.15.B.11 of the Zonin Ordinance. 4. The applicant shall receive and retain, if re a Hazardous Generators License from Washin Count for the Stillwater Auto Clinic operation. 5. All proposed si shall be in compliance with Section 401.1.5.E of the Zonin Ordinance. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval.
