HomeMy WebLinkAbout2003-02-25 CC Resolution #03-02-13RESOLUTION NO, 03-,02-13 OF THE ��,� CITY COUNCIL Q� CITY OF OAK PARK HE IGHTS WASHIN COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY DDD LLC FOR A CONDITIONAL USE PERMIT/PLANNED UNIT DEVELOPMENT AMENDMENT TO ALLOW FOR BUILDING AND SITE PLAN CHANGES FOR CONSTRUCTION OF BUILDING TWO AT MEMORIAL AVENUE NORTH AND 55TH STREET NORTH SHOULD BE APPROVED WITH CONDITIONS W REA S, the Cit of Oak Park Hei has received a re from DDD LLC for a conditional use permit/planned unit development amendment to allow for buildin and site plan chan for construction of Buildin Two at Memorial Avenue North and 55"" Street North and after havin conducted a public hearin relative thereto, the Plannin Commission of Oak Park Hei recommended that the application be approved with conditions. The Cit Council of the Cit of Oak Park Hei makes the followin findin of fact: follows, to wit: 1 . The real propert affected b said application is le described as SEE ATTACHMENT A and 2. The applicant has submitted an application and supportin documentation to the Communit Development Department consistin of the followin items: SEE ATTACHMENT B and 3. The subject site is zoned B-3, Hi Business, and Warehousin District, in which business warehousin activities and commercial and professional offices are permitted uses and 4. The proposed site plan chan include increasin the number of parkin spaces to a total of 99 and decreasin the size of Buildin Two to 7,604 s feet and 5. The Cit staff prepared a memorandum dated Februar 6, 2003 reviewin the re and 6. The memorandum dated Februar 6, 2003 recommended that the re be approved with conditions and 7. The Plannin Commission held. a public hearin at their Februar 13"', X003 ) took comments from the applicants and public, closed the public hearin and rec ptn ' mended that the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HE IGHTS THAT THE CITY COUNCIL APPROVES FOLLOWING: A. The applicant should explore incorporatin additional vertical features in the facade of Buildin 2. 2. The g radin g , draina and utilit plans are subject to review and approval of the Cit En 3. The landscape plan is subject to review and approval of the Cit Arborist. 4. The site plan that includes parkin up to the east propert line and is labeled Exhibit 7 in the plannin report is rejected. 5. Buildin 1 and 2 shall be permitted a total of 17,604 s feet of floor area for office use in combination with a total of 7,200 s feet of floor area of warehouse space based upon a total parkin capacit of 99 stalls on site. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval. (401.03.C.4.a and b) PUD Amendment - Limitation on General concept Plan Approval: Unless a General Plan of Development covering the area designated as in the General Concept Plan as the first stage of the PUD has been filed within twelve (12) months from the date Council grants General concept Plan approval, or in any case where the applicant fails to file General Plan of Development stage and Final Plans and to proceed with development in accordance with the provisions of this ordinance and of an approved General Concept Plan, the approval may be revoked by Council action.
