CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY DDD LLC TO AMEND ITS CUP /PUD FOR PROPERTY AT MEMORIAL. AVENUE NORTH AND SS STREET BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from the DDD LLC to amend its CUP /PUD to allow for access on the northerly side of the west building and to remove the center island between the two buildings located on property at Memorial Avenue North and 5 5th Street; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the amended CUP/PUD be approved with conditions. The City Council makes the following findings of fact and resolution: 1. The real property affected by said application is legally described as Lot 2, Block 1 Kern Center 2" Addition and The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT A follows, to wit: and 2. The subject site is zoned B -3, Highway Business and Warehousing District in which business and warehousing uses are a permitted use; and 3. DDD LLC proposed a change in the site plan to add a driveway on the northerly side of the west building to improve access and to remove the landscaped triangle between the two buildings to allow for better delivery truck access; and 4. City staff prepared a memorandum dated July 31, 2001, reviewing the request for the CUP /PUD; and 5. Said memorandum recommended approval of the CUP /PUD and site plan subject to the conditions listed below; and 6. The Planning Commission held a public hearing at their August 9, 2001 meeting, took comments from the applicant and the public; closed the public hearing; and recommended that the amended CUP /PUD and site plan be approved subject to the fulfillment of various conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL RECOMMENDS THE FOLLOWING: A. That the request for an amended CUP /PUD and site plan for the DDD LLC to allow for access on the northerly side of the westerly building and removal of the center island between the two buildings located on property at Memorial Avenue North and 55 Street affecting real property as follows: Lot 2, Block 1 Kern Center 2' d Addition Be and the same as hereby approved by the City Council of the City of Oak Park Heights for approval with the following conditions: 1. The driveway access at the north side of the westerly building shall be at least 20 feet wide. 2. The storm water pond shall be constructed compliant with recommendations of the Valley Branch Watershed District and the City Engineer. 3. The trash enclosure shall be sized to accommodate at least two dumpsters and shall be constructed of materials similar to the principal buildings on site. 4. All conditions of the CUP /PUD and site plan approval made by the City Council at their April 24, 2001 meeting shall be complied with by the applicants. August 2001.
