BOX 2007 LINDY SWANSON OAK PARK HEIGHTS, MINNESOTA 55082 CHIEF OF POLICE TELEPHONE: (651) 439 -4723 FAX: (651) 439 -3639 EMERGENCY: 911 June 14, 2001 Ms. Wendy Foster; Stillwater Eagles Aerie 94 13523 N. 60th St Oak Park Heights, MN 55082 Dear Ms. Foster; I am sending this note in regards to the failure of Eagles 94 staff during our police departments recent Alcohol Compliance Check. Your bartender served alcohol to a person under 21 years of age "after checking the persons Minnesota Drivers License ". The Oak Park Heights City Council previously passed a resolution which provides a criteria to be used in the event that a liquor license holder fails a compliance check. Based on that resolution, I have recomended that the city council sanction the Eagles 94 Club the amount of $500.00 This is the amount set for a first offense. Checking our police department records, I find that your club failed at least two previous compliances check. The city resolution however, establishes a grace period if a liquor license holder has had no compliance check failures in the most recent 24 months. You had no failures in the last 24 months thus we will consider this to be a "first offense" for sanction guideline purposes. The city council has set a Order To Show Cause Hearing for the next meeting which is June 26, 2001 at 7:00 pm. Yourself, as club manager, or any board members may appear and be heard at this scheduled meeting. Should you choose to waive this hearing please contact me and advise me of that choice. If you choose to waive the hearing, I will be at the meeting and will make my recomendation of a $500.00 cash sanction against the club. If you have any questions or concerns regarding this matter please do not hesitate to contact me at the above listed telephone number. I do want to advise you that I anticipate receiving more grant funding for alcohol compliance checks from the State of Minnesota so I suggest you might meet with those persons selling alocohol at your club and advise them to be more careful as I do anticipate conducting several more checks in the near future and throughout the next year. When checking a Minnesota drivers license it clearly lists the month, day, and year of the license holder's 21 st birthday. We find in most failures, persons check for I.D., review the I.D., and still provide alcohol to the under age volunteer. It they are having problems calculating the age, they can just look at the area that provides the date of the 21 st birthday. Obviously, if that date has not yet been met, they should then refuse service. If I can be of assistance or service in any way, please don't hesitate to contact me. Si erely, Lindy Swa son Chief of Police CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA IN RE: ON -SALE LIQUOR AND /OR WINE LICENSE ORDER TO SHOW CAUSE TO: STILLWATER EAGLES AERIE 94,13523 60' Street, Oak Park Heights, Mn 55082 At the direction of the City Council for the City of Oak Park Heights, it is hereby ordered that you, Stillwater Eagles Aerie 94. or your representatives, appear before the City Council of the City of Oak Park Heights at 7:00 p.m. on June 26, 2001, at the City Municipal Building located at 14168 Oak Park Boulevard No., Oak Park Heights, Minnesota 55082, or as soon thereafter as council can be heard and show cause, if any you have, why an order should not be issued by the City Council for the City of Oak Park Heights limiting, suspending or revoking your 2001 On -Sale and/or Wine License as had been previously issued by the City of Oak Park Heights to Stillwater Eagles Aerie 94. Specifically, you should show cause why your license as referenced above should not be suspended, revoked or other sanctions imposed by the City of Oak Park Heights as a result of illegal sales of liquor to a minor as occurred on your premises on May 17, 2001.
