An incomplete application will delay the processing and may necessitate a re-scheduling of the review time frame. The application approval time line commences and an application is considered complete when all required information and fees are submitted to the City. Sixty (60) Day Waiver: The City hereby notifies the applicant that development review may not be completed within the required 60 days due to public hearing requirements and agency review,. therefore, the City is taking an automatic 60-day extension for development review. The reason being that the General Contractor made a mistake during construction. Wn had specified green canopies in our building specifications. But now looking at the building we feel that the brown matches the building colors better because of the tinted glass and the brown brake metal around the windows. We also would like to point out that our color configuration more closely matches the Bank building which also has the brown roof system, and since both these buildings are on the outer perimeter of this development the current colors certainly appears to be acceptable. Variance: Other Commercial: Currently our Burger King located at 5907 Neal Avenue has an identification problem. This problem exists because of the City requirement that the building does not have the Burger King standard building look and signage, and the fact that visibility from Highway's 36 and 5 is non existent. Because of the physical location and surroundings we need to improve the identification of the building and obtain better visibility from the highway. This can be accomplished by the following: 1. Install a freestanding pole sign that is 59 feet high Burger King, Rainbow and Oak Park Ponds sign. The Burger King sign dimension is 16 X 16. A clock would be included on the sign. 2. Install red parapet lighting around the perimeter of the building. 3. Replace existing Burger King raceway letters on the north and west side of the building and replace them with 8 X 8 Burger King logo signs. 4. At the Oak Park Ponds entrances install 3 X 3 Rainbow and Burger King logo signs in conjunction with the current Oak Park Ponds identification signs. 5. Install a highway sign for Burger King and Rainbow on the south side of highway 36 before the highway 5 exit ramp. We have enclosed images of ‘vhat these signs would look like. Theses requests will not be detrimental to the public welfare or to other land owners or improvements in the neighborhood. This will 0111) help solidify the city's commitment to help develop healthy businesses in your community. If both Rainbow Foods and Burger King were to close because of lack of business it would certainly have an effect on the future of Oak Park Ponds. As we all know the tax base of commercial property is important to the community and the city.
