Box 2007 • Oak Park Heights, MN 55082 ® Phone (651) 439 -4439 • Fax 439 -0574 For your information and review, Burger King representatives have met with City staff to discuss their intent to apply for a variance to allow the awnings on the building to remain the brown color as installed, Vs the green color as approved. We anticipate that this application will be presented at an April 1999 Planning Commission meeting. The attached letter outlines Burger King's compliance with additional items including dumpster storage, lighting, and parking signs. We will have PP . c.. ���rth the City to gave the application in to the City for the April meeting. The reason for the delay is that also at that time we want to address some building identification ask that this deadline be extended until the outcome g cation concerns. of the variance process is determined. #3 In regards to the venting of the broiler. the specifications of the broiler meet all specifications. I have attached copies of the manufacturers specification sheets that specifications of the broiler hood. In my disc discuss the general ussions with the MN Pollution Control Agency, the` have indicated that they have ref ulauons for certain types of pollution. Specifically they have 5 pollutants. These pollutants are 502. P ati e control over Lead. CO2. NOX and PM. none of which we are emitting from our facility. So in the guidelines of the NWPCA. . their opinion �ti e meet #4 All durnpsters are stored inside now. #5 The exit pads to the rear exit door is clear. #6 The handicap parking signs are in place.
