Please be advised that the Planning Commission, at their November 18, 1999 meeting,
voted unanimously to recommend that the City Council cancel the CUP for Burger King
unless they apply for design review consideration before November 23,1999.
The recommendation to cancel the CUP is based upon the October 25, 1999 letter to
Greg Dolphin from Kris Danielson indicating the issues with signage and landscaping
as violations of the terms of the CUP.
Representatives of Burger King have proposed to add height to the roof of their
structure to make the existing signs compliant. This would require design review
including Planning Commission review and City Council consideration. The Planning
Commission would consider this request at their December meeting. The landscaping
issues would also need to be addressed and approved by the City Arborist.
A copy of the October 25, 1999 letter and the Burger King proposal for changes to the
building are attached.

1 am writing to you to inform you that several items are still outstanding regarding your
Burger King development in Oak Park Heights. As a result please be advised that you
are in violation of the terms of the conditional use permit issued for your business.
Signage: The signs installed extend beyond the parapet walls and are in violation of the
city's sign ordinance. A copy of the ordinance section is included with this letter for your
review. The existing signs must be removed and replaced with signage that fits inside
the building facade as depicted in your application materials for the alterations to the
signage. A copy of this section of your application materials is also included with this
letter. The Planning Commission and City Council approval for the signage
modifications were based on the renderings you had submitted.
When detailed plans were provided to the building official as part of the permit
application process, you and /or your contractor were notified that the proposed sig ns
would not be permissible under the zoning ordinance and a permit was not issued to
install these signs. The signs were nonetheless installed without a permit.
Landscaper_ As the attached memo from the City Arborist outlines, attention must be
given to the trees located on the site immediately.
Unless these issues are immediately corrected, it will be staffs recommendation to the
City Council at their meeting of 11/23/99 to cancel the conditional use permit under
which your business is permitted to operate. if the City Council deems it appropriate to
follow staffs recommendation, all operations associated with your business at this
location must immediately cease and desist.
