BOX 2007 LINDY SWANSON OAK PARK HEIGHTS, MINNESOTA 55082 CHIEF OF POLICE TELEPHONE: (651) 439 -4723 FAX: (651) 439 -3639 EMERGENCY: 911 March 16, 2000 Mr. Richard Lynch -Store Manager MGM Liquor Warehouse 14617 N. 59th St. Oak Park Heights, MN 55082 Dear Mr. Lynch; I am sure that you are aware that on Tuesday, March 14, 2000 the Oak Park Heights City Council upheld recommended sanctions pertaining to your store and its second failure to pass our police department's alcohol compliance checks. The established sanctions were a $1,000.00 civil fee penalty and a five consecutive day, Monday - Friday, suspension of the city issued liquor license. I believe that you will be invoiced by the city finance department for any cash sanctions, but would like to give you an opportunity in selecting the time period that the liquor license sanctions shall be in effect. I must insist that the sanction period be completed prior to May 1, 2000. Please contact me prior to March 28, 2000 if you have any input you would like to share regarding the liquor license suspension period. If I do not hear from you by March 28, 2000 I will select a time period for the license suspension and shall notify you by having a written order delivered. I realize that this could be considered to be a rather negative situation by yourself and employees but assure you that we only have the best interest of the public's safety in mind. Hopefully this will be a learning experience and we can avoid a similar occurrence. I await to hear from you. I recently received a telephone call from Mr. John Lanners requesting that the license suspension period be from Monday, April 24, 2000 thru Friday, April 28, 2000, inclusive. I advised Mr. Lanners that those dates appeared to be fine and we then agreed that that would be the designated license suspension period. You are hereby advised by this letter. I would also like to suggest, that due to the fact that the license will be under suspension for those dates, that you either leave the store entrances secure so that the general public does not have access, or remove any and all liquor that would be accessible should you decide to leave the entrance area open. I sincerely hope that this will prove to be a positive experience for your staff and that we can avoid this type of problem in the future. I do understand that it is easy and natural to "transfer the blame" onto myself and/or my staff, but hope that you understand that we have a job to do and that we treated your store and staff the same as all other liquor license holders in our community.
