PLANNING COMMISSION MEETING MINUTES
Thursda Au 14, 2003
Call To Order: Chair Dw called the meetin to order at 7:00 p.m. Present:
Commissioners Oswald, Runk and Powell. Cit Administrator J ohnson, Cit Planner Richards and
Corntmssion Liaison McComber. Absent: CoilliTlissioner Lil

D. Dvorak Rear Yard Setback Variance: To consider a re for a variance for a rear y ard
setback at 5989 Olinda Ave. N.
Cit Planner Richards reviewed his report and provided an issue anal for the re q uest, notin that
there is no hardship shown. He added that the zonin ordinance would permit a free standin
screen porch to be constructed as an accessor buildin He briefl discussed that the accessor
buildin could be connected to the deck as lon as there were no breezewa or roof cover
constructed that would attach it to the main house. Due to the lack of hardship shown, the
Commission is bein asked to consider denial of the re
Chair Dw opened the hearin for public comment.
Mike Dvorak introduced himself as the applicant and a 28 - resident of the communit He
in as to whether or not the Cit received an ob to his re It was noted that none
had been received. Mr. Dvorak stated that he could not understand the lo of bein able to build
a free standin screen porch, which would brin him closer to his propert line versus that of one
connected to his home which would be further awa from the propert line. He discussed how
access to the porch would occur from the home if built off the home. He added that he spoke with
one of his nei who is a propert appraiser, about the concept of buildin a freestandin
porch versus one off the home. He stated his nei did not see the lo in buildin a separate
structure.
Discussion ensued as to the original placement of the home on the propert similar placement
throu the nei hardship possibilit based upon location of home on lot, setback
issues and possibilities of other locations for a screen porch or room for g rowth. Discussion was
also had as to the concept of deck design and a screen porch structure attached to it. Chair Dw
expressed that he is interested in lookin at a hardship versus havin a deck with a screen porch but
prior to creatin precedence he would like more information about the nei lots.
Chair Dw noted that based upon the Con-irmssion. s charter re q uirements, the are forced to den
the re q uest based on lack of a hardship bein shown. However if there is a case for hardship he
expressed his willin to look at the nei as a whole.
Commissioner Powell, seconded b Vice Chair Runk, moved to continue the public hearin to
September to allow time for additional information to be provided. Carried 4-0.
Discussion ensued as to information the Commission would like to see in September, includin that
of setbacks of nei homes, zonin re in place at time home was constructed. The
Commissioners will take a closet look at nei prior to the September meeting.

Adjournment Commissioner Powell, seconded by Commissioner Oswald, moved to adjourn
at 5:35 p.m. Carried 5--0.
