At their April 27, 2004 meeting, the City Council requested the applicant examine a number of the points discussed by staff and the Planning Commission in their review. The plans were not changed significantly from the previous site plans. A 10 foot setback has been provided along the west property line, making the project conforming with the side yard setback requirements, although the two office buildings continue to have a 25 foot front yard setback instead of the required 40 feet. The grading plan indicates the proposed location of Mn DOT's frontage road improvements. The applicant addressed much of staff's, Planning Commission's, and the City Council's issues as follows: "1. The condominium building footprint was revised to meet the 10' minimum setback along the west property line. 2. The L -shape of the condominium building not only provides a more aesthetically pleasing appearance to the building but also leaves space available for the required storm water pond expansion and parking. 3. The height of the condominium building will be masked on the south side with rows of spruce trees located between the building and the existing town homes. The spruce trees will provide the residents with a natural backyard environment as well as an improved sound barrier for the Highway 36 traffic. 4. The existing utility easement could be narrowed from 70 to 75 feet wide to approximately 40 to 45 feet by replacing the existing sewer utilities. However, At their May 25, 2004 meeting, the City Council should review the new plans and issues addressed above. A revised resolution has been prepared for their consideration as attached. 7. Revisions to the concept grading plan have been made to show MnDOT's proposed improvements to 60 Street North. The conflicts to this site are minimal. 8. Screening around the pool will include a combination of an earth berm, fence and spruce trees. We understand the maximum fence height is 8 feet." given the site topography, storm water ponding requirements, parking requirements and setback restrictions, the narrow easement adds very little flexibility to the site layout options. The re- routing of utilities along the north and south side of the property were evaluated. In both cases, conflicts with the proposed buildings and/or existing roads would be encountered. 5. Revisions to the site layout were considered so that the 40' setback from the north property line to the proposed office buildings was met. Displaced parking from the south side of the building will need to be relocated to the north side of the building. However, since these buildings are one story tall with access on the south side, parking on the north of the building would be undesirable for business transactions. Because of the limited parking spaces on this site only single story office buildings are being proposed. 6. CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY RIVER VALLEY RENTALS, LLC FOR A MIXED USE, PUD CONCEPT PLAN FOR A 32 UNIT RESIDENTIAL CONDOMINIUM BUILDING AND TWO OFFICE BUILDINGS LOCATED EAST OF OSGOOD AVENUE AND SOUTH OF HIGHWAY 36 BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from River Valley Rentals, LLC for a mixed use, PUD concept plan for a 32 unit residential condominium building and two office buildings located east of Osgood Avenue and south of Highway 36; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the application be approved with conditions. The City Council makes the following findings of fact and resolution: 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: follows, to wit: and and SEE ATTACHMENT B 3. The subject site is zoned a combination of B-2, General Business District on the northern portion of the site and R -B, Residential Business /Transitional District on the south; and 4. The planned unit development has been requested to allow multiple buildings on one property and the shared access and parking arrangement of the proposed site plan; and 5. City staff prepared a planning report dated March 5, 2004 and April 1, 2004 reviewing the request for the PUD concept plan; and 6. The April 1, 2004 planning report recommended approval of the PUD concept plan subject to the fulfillment of conditions; and 7. The Planning Commission held a public hearing at their March 11, 2004 and April 8, 2004 meetings, took comments from the applicants and public, closed the public hearing, and recommended that the applications be approved subject to the fulfillment of conditions; and 8. The City Council, at their April 27, 2004 meeting, reviewed the Planning Commission recommendations and asked the applicant to provide additional information for their May 25, 2004 meeting. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by River Valley Rentals, LLC for a mixed use, PUD concept plan for a 32 unit residential condominium building and two office buildings located east of Osgood Avenue and south of Highway 36 and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject to the following conditions: 1. The City's Land Use Plan be amended to accommodate the proposed residential use component of the project. 2. The applicant demonstrate eligibility for the residential density bonus. 3. The concept site plan is approved with a minimum 25 foot front yard setback to the property lines. 4. As p art of the PUD development stage plan submissions, a detailed tree inventory and landscape plan be submitted. As part of the landscape plan submission, particular attention should be given to the screening of the swimming pool area from the adjacent private roadway and residences. 5. Issues related to grading, drainage and utilities be subject to comment and recommendation by the City Engineer. 6. The labeling of the condominium building elevations on the site plans be corrected. 2 7. The applicant shall address the usability of the row end parking stalls within the condominium building's underground parking garage as part of general plan of development submission. 8. As part of the PUD general plan of development submission, the applicant provide details of the trash enclosure. The enclosure materials shall be consistent with the materials used on the condominium building. 9. With the general plan of development, the applicant submit information related to lighting and signage. 10. The stornwater plan and any changes to the existing pond shall be subject to review and approval of the Minnesota Pollution Control Agency. 11. A MnDOT access permit shall be required. Box 2007 Oak Park Heights, MN 55082 -3007 Re: East Oaks PUD 2nd Addition - PU D Concept Plan Dear Mayor Beaudet and Council Members: 1937 South Greeley Street Stillwater, MN 55082 Tel: (651) 439 -0189 • Fax: (651) 439 -5085 Enclosed is a revised conceptual site plan and grading plan that includes additional information and changes requested at the last City Council meeting. 1 regret that 1 was not able to attend the Council meeting on April 27th to answer specific questions regarding the building layouts for this project. 1 have viewed the video tape of the meeting and attended a workshop session with the City staff on May 5th, We hope the information in this submittal better addresses the questions you had and more clearly presents the intent of the design. As you know, the topography and the existing utility easement greatly limit the development options for this site With that in mind, the following items address specific questions raised at the last meeting. 1. The condominium building footprint was revised to meet the 10' minimum setback along the west property line. 2. The L -shape of the condominium building not only provides a more aesthetically pleasing appearance to the building but also leaves space available for the required storm water pond expansion and parking. 3. We understand the maximum fence height is 8 feet. 1 feel strongly that the proposed concept is the best use of this property, provides aesthetically pleasing structures and meets the requirements set forth by the City. I will be attending the Council meeting on May 25th when you again consider the conceptual plan for this project.
