Conditional Use Permit

As you are aware, the Planning commission and city council have acted on the
conditional use permit for the expansion of the First Presbyterian church at 8201 Osgood
Avenue North. The Planning Commission, at their 23 November 1998 meeting,
recommended the conditional use permit with the slightly amended conditions found in the
18 November 1998 planning report. The city council approved this conditional use permit
at their 24 November 1998 meeting with the following conditions:
1. Either the building design should be revised so that the building is 30 feet from the
north property line with the eave encroaching no more than two feet into the
required front yard, or an application for a variance should be submitted.
2. The grading and drainage plan shall be subject to city Engineer review and
approval.
3. A landscape plan must be submitted indicating trees to be removed and proposed
plantings for approval by the city Arborist and city staff. It would be appropriate
to plant a shade tree at the northwestern end of the block in an existing gap and
landscape the north side of the driveway along 02nd Street North.
4. A plan showing proposed exterior lighting is required. Any changes to the exterior
lighting on the structure shall require approval of city staff.

5. Extension of the one year time limit for construction of the expansion to three years
from the date of city council approval (24 November 1998).
B. The church shall allow the city of oak Park Heights to utilize a portion of their
facility for an election polling place.
A copy of the letter from Paul May, the church's architect, responding to the conditions is
attached. if you have any questions, please do not hesitate to call.

I have received your summary for the project, and appreciate your prompt review. You have noted 4 conditions
in the Recommendation and conclusion section. i would like to respond to these prior to the Planning
Commission meeting on Monday, in hopes it can nuke the meeting go smoothly.
I . Either the building design should be revised so that the building is 34 feet from the north property
line with the eave encroaching no more than two feet into the required front yard or an application
for a variance should be submitted. The north addition is part of phase two of construction and will not
be completed at this time. The north eave that in encroaching will be redesigned at that time to meet the
required set back, or a variance will be applied for at that time.
2. The grading and drainage plan shall be subject to City Engineer review and approval. No major
changes to the existing drainage plan are proposed. We will review with the city Engineer any areas
desired.
3. A landscape plan must be submitted indicafi°ng trees to be removed and proposed plantings. It
would be appropriate to plant a shade tree at the northwestern end of the block in an existing gap
and landscape the north side of the driveway along 6e street North. One tree located within the
addition area is proposed to be removed. Planting plans for low level vegetation will be completed by the
congregation members next fall.
4. A plan showing proposed exterior lighting is required. No changes to the existing exterior lighting are
proposed.
