Re: Cross easement across Bracke Second Addition and Oak Park Ponds
Dear Kris:
Since our last letter to y ou concernin the above referenced matter, Ja Mohr has
replaced Keith Ulsted at Oppidan Investment, and the mort lender on the propert
has consented to the cross easement. The onl interested part that has not y et consented
to the easement is Flemin Foods, parent of Rainbow Foods.
Ja *informed me last week that he had sent the easement documents to Flemin for their
si but Flemin would not si the easement until the reviewed minutes of the
Aril 8, 2001 Oak Park Hei Cit Council meetin Appatentl Ja told Flemin that
consent to the easement was one of the conditions imposed b the Conditional Use
Permit and Flemin wanted to verif that fact.
I believe I have done ever I can and ever the Cit wanted me to do in
connection with this easement issue, but I would appreciate it if y ou would send me a
cop of the Cit Council minutes that pertain to the cross easement for m further review.
If I am correct in m assumptions, thou the onl wa that the cross easement can be
filed is if the Cit notifies Ja Mohr and Flemin formall or informall that

Flemin has not complied with the terms of the conditional use permit for the Rainbow
g as station.
In an event, let me know what y ou think. (I think Flemin continues to believe that the
cross easement is a condition that I imposed on them, which is of course incorrect.)
