As discussed, we are diligently working to re-lease the former Rainbow Store at oak Park Ponds, however because we remain uncertain at this time what type of tenant may lease the space, we would like the.City of oak Park Heights to consider providing the landowner, Prudential Insurance company, a six -month extension beyond July 1, 2004 of the Conditional Use Permit (C.U.P.) for the operation of the fuel center. We are in the process of obtaining bids to remove the underground tanks and restore the area, therefore will be prepared to proceed if there is no use for the fuel center. However, the additional time will be advantageous in the event we lease the space and determine there is a need for it. Thank you for your understanding. we hope you can understand and appreciate the complexity and challenge we have in re-leasing 65,000 sq.ft. at oak Park Ponds Shopping Center. Mr. Frank, It is the City's understanding that KTJ and/or Flemming Properties d is not the owner of the 5801 Kern Road property; and that your firma is the owner. As you are aware, your property does maintain a Conditional Use Permit (C.U.P.) for the operation of a 'Fgasoline station ". Such C.U.P. was initially issued to the Flemming Properties and/or RTJ Limited Partnership Eleven - in May 2001.1 have attached for your file a copy of the C.U.P. permitting such gas station. However, the C.U.P. for such gas station will expire on July 1 2004 as such facility would not have been in use for more than one year. Should the C.U.P. expire, the infrastructure (pumps, tanks, canopy, etc) and the operation of same, would be in violation of City ordinance - operating without a C.U.P. Ultimately, the City could require you to remove such infrastructure and the restore the property to a condition suitable to the City. Alternatively, you would need to reapply to the City for a new C.U.P. to again operate and maintain such facility - but such re- application must be submitted and approved by the City. Be advised, that this letter is to inform you that the City will expect full compliance and with the requirement of a C.U.P. (and any other agreement) and that operations must substantially recommence prior to the July 1, 2004 date. My office would appreciate some return correspondence as to your plans for the gas station.
