RE: Status of Development Application
Dear Mr. Gullickson,
On May 12', 2005, the Planning Commission was prepared to consider your application
for an expansion to your property at the above address. Specifically, a 24' x 16'
expansion to the western side of the building. Also to be considered was a necessary
Conditional Use Permit (CUP) as the property is in fact an illegal use triplex, That
evening, fi m ediately prior to the commencement of the meeting you had indicated to nee
that you may now have secured an option to purchase property from the neighbor to the
north (Xcel), which could potentially accommodate and/or facilitate an expansion of your
facilities into a 4 -unit complex.
Accordingly, it was determined with your concurrence to not proceed with the public
hearing of your initial application (CUP to allow a triplex ---- to get to a conforming
standard and authorize expansion) as this process could conceivably have been repeated
in the near future by your requesting approval for a 4 -unit complex; The Planning
Commission tabled the public hearing until the June 9 t ', 2005 meeting. However, should
your project ultimately not be granted a CUP for either a three or four unit, you would be
required to vacate one of the three units. You have been made aware that your property is
not a `legal non - conforming" use or structure; I have provided to you a letter from the
City ]wilding Official addressing this matter.
The City is in receipt of your letter withdrawing your current applications for a CUP for a
triplex and its related variances. However, at this time the City is not prepared to address
your 4 Alex proposal as to date we have not received the following: a signed
Development Application, project narrative, elevations and plans of the new structures,
drainage plans for the entire site, a copy of your option to purchase the abutting property,
a site plan that demonstrates: the new acreage, compliance with the required garage
spaces, building setbacks. Upon the receipt of this information by the City from you, not
to be later than June 8 , 2005, the City will review for completeness and, if complete,
will initialize the process for a July public hearing by the Planning Cornnfission.
Please note that if approval is ultimately granted for your 4 -unit, you will be required to
secure a NEW LAND SURVEY by a Minnesota Licensed Land Surveyor that shows
your current parcel, its structures and the new area to be combined, This is considered a
minor subdivision under the City's 402 ordinance. Without such survey the property
cannot be conj' oined and building permits will not be issued. ]deep in mind that the final
survey must exactly demonstrate compliance with all setbacks and distances prior to any
building permit being issued.
