RE: Re to Install Footin and Foundation.
Dear Mr. Gullickson,
As y ou are aware, the Cit Council did recentl approve y our conditional use permit
( CUP ) with re conditions. However, to date y ou have not secured and provided to
the Cit the re Certified Surve map showin the propert conjoinment nor proof
of the propert transfer to y ou from Xcel Ener Until such time as these elements are
brou to the Cit y our project will not be allowed to move forward.
The CUP primaril deals with the expansion of y our buildin to the north,
accommodatin at least in part, the fourth dwellin unit. The other element of y our
application was related to a more strai buildin expansion to the west. VVhile it
is true that this expansion does not in of itself need variance, y our current use of the
buildin remains an ille use until such time as the CUP is issued and y ou come into
full compliance with the terms of that CUP.
Accordin the Cit t cannot issue a buildin pen-nit on a non - conformin
structure and/or use. However, y ou do maintain y our approvals from the Cit subject to
the above discussion. and the approval resolution. Therefore, the Cit will approve y our
re to allow y ou to start and cons fete the footin and foundation for this west side .
expansion only, no other work related to y our project ma be commenced includin an
other site work.
As per our conversation, y ou will be re to submit a permit application and two
desi plans for the footin and foundation for the westerl expansion, which are subject
to the review and approval of Buildin Official. No work shall commence on the footin
and foundation until such time a permit has been issued to y ou for the work, No other
work ma be commenced nor permitted M" the future includin the structure to sit atop
this newl installed footin until the CUP conditions are satisfied.
Should you fail to complete the required elements of the CUP and/or should you not
secure and combine the property from Xcel Energy, you will be required to remove such
footings and foundations as permitted under the terms of this letter and you will be
required to vacate the third residence from the premises. Be advised that your CUP
remains in effect for a period of 12 months and you must engage Mn substantial
construction of these improvements wiWn this time period. Wherefore, please make all
efforts to secure the required survey from a certified surveyor and property from Xcel
Energy.
