HomeMy WebLinkAbout2007-08-29 NAC Ltr to ApplicantDear Mr. Dove: As you are aware, the oak Park Heights City Council, at its meeting last night, approved the portion of the original development application related to the automobile dealership. The request for the Comprehensive Plan amendment and the rezoning for the area to be described at Outlot A, Jacobs Third Addition was not acted upon. The development timeline for those two items ends on October 10, 2007. The city will further study the issue of amending the existing B -3, Highway Business and Warehouse District in September. As a result, it is unlikely that the city council will act on the Comprehensive Plan amendment and rezoning by October 10, 2007. We request that you provide a letter extending the timeline for development review an additional. 00 days to allow the city to complete its review and possible zoning Ordinance amendment. The following language should be incorporated into that agreement: Pursuant to Minnesota Statutes 75.99, Subd. 3(0, Jerden LLC is herewith extending the period of time for agencylcity review of the applications for a Comprehensive Plan amendment and rezoning for the area to be described as Outlot fit, Jacobs Third addition for an additional 80 day period (for a total of 780 days from the date of application) inasmuch as the City has determined that additional research and study by City staff relative to the complexity of the project as proposed will be required.
