WHEREAS, Human Services, Inc. has applied for and received permission from
the City of oak Park Heights to connect a municipal water and sanitary sewer /storm sewer utility
within the City of oak Park Heights; and,
WHEREAS, the City of oak Park Heights has allowed Human Services, Inc. to
connect to its facilities to serve the property owned by Human Services, Inc., located within the
City of Stillwater, specifically located on the west side of Panama Avenue; and,
WHEREAS, the City Engineer, Bonestroo, Rosene, Anderlik & Associates, has
issues its report with a statement of conditions as contained within its report of October 16, 2004.
NOW THEREFORE, be it agreed between the parties as follows:
1. That Human Services, Inc. hereby acknowledges the report of Bonestroo,
Rosene, Anderlik & Associates dated October 16, 2004 and agrees to the conditions set forth
therein. Human Services, Inc. will comply with the recommendations of the City's consulting
engineers as provided for within said letter and provide a irrevocable letter of credit to the City
of Oak Park Heights in the amount of $13, 125.00 to secure its performance of the demolition and
restoration to the public right-of-way, street, curb and boulevard within Panama Avenue North
and 61" Street Forth as is adj acent to the project area. That the irrevocable letter of credit shall
be issued for a period of one (1) year and shall be renewed thereafter until such time as the City
Engineer certifies that the project has been completed and/or substantially performed to the
satisfaction of the consulting engineers of the City. The City will have the authority to make
claim on the irrevocable letter of credit in the event that the project does not reasonably proceed
in a timely fashion to completion and satisfactory restoration of Panama Avenue North and 64
Street North as affected by this project.

Dear Eric:
We have reviewed the concept development plans and storm water calculations for the proposed
Home Free Apartments development on the west side of Panama Avenue N. across from 64
Street N., as submitted by Cermak Rhoades Architects, and have the following
coinments /recommendations for your consideration:
Site Layout/Access Locations
1. The proposed driveway access location is in basically the same locations as the existing
access and is acceptable as shown..
Grading & Drainage/Storm Sewer:
2. The storm water calculations are acceptable as submitted.
3. Storm water runoff from the majority of this development will be tributary to a proposed rain
garden within the westerly boulevard of 54 Street North. In essence, this rain garden will
function as a small storm water ponding area and rely on infiltration to handle the increase in
storm water runoff from the proposed development. Rain gardens are designed to infiltrate
but also typically incorporate a storm sewer collection system underneath to ensure storm
water runoff removal. In this case, there is no existing storm sewer in the area to connect to,
so the rain garden is relying completely on infiltration. The City should be aware that if the
rain garden infiltration fails to function as assumed, or is inundated during very large storm
events, excess storm water runoff will overflow the rain garden to Panama Avenue N. and
then northerly along Panama Avenue N. and/or easterly down 64 Street N.
4. Additionally, the proposed rain garden location is within the public street right -of -way of
Panama Avenue N. Storm water ponds serving private developments are typically not
allowed within public right-of-way. Rain gardens are sometimes allowed in public right-of-
way if 'incorporated into existing ditch systems in rural type street areas, which is not the case
here. As such, we recommend the rain garden be moved westerly out of the City's public
street right -of -way, unless the City will permit the rain garden in its current proposed
location.

5. As noted in the City of Stillwater's September 9, 2004 internal memorandum, the location
and a detail of an overflow swale for the proposed rain garden should be shown on the plans.
6. Silt fencing is shown on the demolition plan. We recommend the silt fence be extended
along the entire easterly edge of the parcel. Additionally, more detailed sediment and erosion
control items (including, but not limited to, the silt fencing, a rock construction entrance,
storm sewer inlet protection and areas of seeding and/or sodding restoration).
7. The proposed catch basin in noted as including a sump, but the detail indicates the sump be
filled with concrete to the outlet flow line. This defeats the purpose of the sump. We
recommend a 2' sump be incorporated into this catch basin to help with storm water runoff
sediment removal prior to entering the rain garden.
Sanitary Sewer:
8. The proposed 6" sanitary sewer service connection to the existing sanitary sewer manhole
shall be made via core drilling.
9. A minimum 18" separation should be maintained where the proposed sanitary sewer service
will cross under the existing water main in Panama Avenue N.
Water Main:
10. The proposed 6" water service shall be connected to the existing water main in Panama
Avenue N. via wet tap. The oak Park Heights Public Warps Department should be notified
48 hours prior to this connection being constructed.
Miscellaneous
11.64 1h Street N. and Panama Avenue N. shall be restored full -width where the sanitary sewer
and water service installations will be occurring.
12. Demolition and restoration will be taking place to the public street, curb, and boulevard
within the Panama Avenue N. and 64' Street N. right --of -ways for the new driveway access
and sanitary sewer and water service connections. Based on these plans, we recommend the
City obtain a Letter Of Credit from the owner /developer for $13,125 ($10,500 x 125%) to
cover the costs associated with these improvements and City inspection.
