As described in the enclosed resolution, Cit Council meeting minutes of 2/13/01 and Planner's
Memo, the Cit Council approved the vacation of existing drainage and utilit easements for this
preliminar and final plat.
While the easement vacation was approved as a condition of the preliminar and final plat approval, we
are now asking the Cit Council to approve this action b resolution.

RESOLUTION NO. O1-O3-
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION VACATING
DRAINAGE AND UTILITY EASEMENTS
LOCATED WITHIN LOT 2, BLOCK 2, JACOB ADDITION
WHEREAS, an application was filed with the City of Oak Park Heights
requesting the City vacate the drainage and utility easements contained within Lot
2,
Block 2, Jacob Addition; and
WHEREAS, the applicant is warranting and representin g that it is the
owner of land contained within said property; and
WHEREAS, the public hearings as required by law have been ro erl

noticed, with hearings conducted before the Planning Commission of the City of
ty oak
Park Heights as directed by the City Council; and
WHEREAS, the applicant is proposing a replat of the area contained
within Lot 2, Block 2, Jacob Addition with a reconveyance to the City of Oak Park
Heights of corrected and new drainage and utility easements to replace those that

been vacated as a result of this proceeding; and
WHEREAS, the applicant's payment of the costs incurred by the City

with respect to these proceedings is sufficient consideration for the vacation thereof.
WHEREAS, the City Council voted to approve the vacation of the same
drainage and utility easements at its meeting of February 3, 2001 meeting.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
FOR THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City of Oak Park Heights does hereby vacate all drainage

and utility easements now contained within existing Lot 2, Block
2, Jacob Addition.
2 The action of the City of Oak Park Heights is upon contingent u on the
replat of the area known as Lot 2, Block 2 of Jacob Addition and
the rededication therein to the City of oak Park Heights of new
drainage and utility easements in the manner and form p rescribed
and directed by the Office of the City Engineer and City Planner.
Passed and adopted by the City Council for the City of Oak Park Heights
this 27 day of March, 2001.

3. Be it further resolved that the City Clerk shall p p re are a Notice of
Completion of these proceedings which shall contain the name of
the City, the identification of the vacation, the statement of the
time of completion thereof, and a description of the real estate and
land affected thereby. Such Notice shall be presented to the
County Auditor /Treasurer, who shall enter the same in its transfer
records and note upon the instrument over "Entered � g his official signature the
words Into The Transfer Records." The Notice shall
then be filed with the County Recorder of Washington County, g ty�
as required by Minnesota Statute §412.851.

Planner Richards noted that this item was tabled from the last meeting. Richards

reviewed revised site plans for the proposed car wash and reported on the

an.nin Commission approval of the revised plans.
Mayor Beaudet, seconded by Councilmember Doerr, moved to amend the
Planner's report to add language stating that City approval is not inclusive o
pP of
other governmental approvals. Carried 4 — 0.
Councilmember Swenson, seconded by McComber, moved to approve the
preliminary and final plat subject to the amended Planning Commission
recommendations. Carried 4 -- 0.

Planner Richards reported that the applicant has addressed the issues raised at
the
last Council meeting and has redesigned the building accordingly to comply with

setback requirements. Richards further reported that space needed for stacking g has
been addressed with the applicant.
Councilmember McComber, seconded by Doerr, moved to approve the
application with conditions outlined in the Planner's report. Carried 4 -- O.
C. Aesthetic Bridge Design Concept Correspondence.
Administrator Melena provided an update. Mayor Beaudet, seconded by
Councilmember Swenson, moved to receive the information. Carried 4 -- 0.
D. Right to Know Trainin Update.
Administrator Melena reported that this is the last iece of information necessary

for full compliance with OSHA. Councilmember Swenson, seconded by
McComber, moved to receive the information. Carried 4 -- 0.
E. Andersen Corporation TIFIAgreements.
Councilmember Doerr, seconded by McComber, moved to authorize appropriate

action to execute the Agreement. Carried 3 — o — 1, SWenson abstained.
JACOB 2 ADDITION
CITY OF OAK PARK HEIGHTS
The Planning Commission, at their December 14, 2000 meeting, g, d to
approve the preliminary and final plat for Jacob 2n Addition and vacation of existing
drainage and utility easements. The City Council approved the preliminary and fin al plat
and vacation of easements p p ry nts for Jacob 2 Addition at their February 13, 2001 meeting

with the following conditions:
1. The applicant shall shift the site lot line of Lot 2 to the south at the street right-of-
way to allow Lot 1 to have at least 250 feet of frontage on Neal Avenue North.
2. The applicant should plat Outiot A as part of Lot 2.
3. The drainage and utility easements of Lot 2, Block 2, Jacob Addition be vacated
and replaced with the easements indicated on the relimina plat/final plat for

4. All access points and utilities shall be subject to the review and approval of the
City Engineer.
5. City approval is not inclusive of other necessary governmental permits p tsand
approvals, including but not limited to MnDOT access and permits,
a ermits

approvals that may apply.
