MEMORANDUM TO: Kimberly Kamper FROM: Cynthia Putz-Yang 1 Scott Richards DATE: November 5, 2002 RE: Oak Park Heights — Stillwater Ford/Conversion Van Center; CUP and Site Plan Review FILE NO: 798.02 — 02.30 BACKGROUND Jacob Holdings of Stillwater LLC has made an application for a conditional use permit to allow van and truck sales and display on a lot adjacent to the Stillwater Ford dealership. A conditional use permit was approved for the site in October of 2001 to allow off-site parking for the Stillwater Ford dealership. Current plans include a 2-story building with 5,000 square feet per floor. The building would be used for sales and offices. The lot is 1.37 acres, is described as Lot 1, Block 2 Jacob 2 Addition, and is located directly west of the Stillwater Ford dealership on Neal Avenue. The property is owned by Jacob Holdings of Stillwater LLC and is zoned B-2, General Business District. North of the site is an Arby's, and Pony Express Car Wash is located to the west. To the south is a driveway for Pony Express and a stormwater pond. Retail sales p ales is a permitted use in the B -2 General Business District. Section 401.30.E, conditional uses in the 13-2 General Business District, allows open and � principal accessory outdoor sales as a rind al or accessor use. Specific conditions for CUP approval are listed in the Zoning Ordinance and reviewed within this report. p CUP Request A conditional use permit is being requested to allow open and outdoor display and sales of p f vehicles. The site plan illustrates that there will be parking stalls for 78 vehicles on display, and 20 stalls for customer parking. Parking stalls are dimensioned at 19 feet long. They are required to be at least 20 feet long. Stall width is compliant at nine feet wide. Drive aisles must be at least 24 feet wide. The landscape plan that was submitted in October previously proposed for the reviousl roposed parking lot was an attractive plan that utilized good plant p lined several ood lant s ecies. 1 would suggest that they try something similar to that plan for the landscaping. The landscape plan submitted in October of 2001 is attached in Exhibit 4 for reference. A revised landscape plan must be submitted and is subject to review by the City Arborist. Parking. The City's zoning 's existin zonin code does not have a specific parking standard for car, van, or truck sales. The closest standard relates to boat sales, and that standard parking requirements been used to evaluate arkin uirements for other vehicle sales lots in Oak Park q Heights. Boat sales require space for each 400 square feet of floor area for the first q one p 25, 000 square feet, plus space one s ace for each 600 square feet thereafter. Floor area is q uare determined by subtra ctin g ten percent from each floor of the two -story building. The building square is 10 000 s feet in size. After subtracting ten percent, the floor area is 9,000 square feet in size. The floor area divided by 400 is 22.5. Therefore, 23 parking spaces are required. Section 401.15.F.7 of the Zoning Ordinance prohibits use of required parking for outdoor storage or sales. The site plan must be revised to indicate that 23 stalls are reserved for customer parking. Building Height and Design Guidelines. The proposed two -story building is parapet. B . 7 . d of the Zoning Ordinance (outdoor lighting) states that light shall not exceed one foot candle measured from the centerline of a public g street, nor shall light exceed four - tenths of a foot candle at any property line adjoining an . adjacent property. Light levels on the lighting plan are exceeded on all property � p p y g lines; therefore, g the lighting plan must be revised to comply with the City's foot - candle limitations. Sl na e. One wall sig n is proposed on the front of the building. The proposed sign is � � 45 square feet in size. The Zoning Ordinance allows a wall sign that is up to 64 square feet in size; therefore, the sign complies with City standards. Trash. The site p lan illustrates a trash enclosure on the northwest side of the building. The plan plan site lan includes a lan detail of the trash enclosure; however, elevation details have not been provided. Elevations for the enclosure must be submitted with materials specified. The enclosure materials must be consistent with the principal building materials. CUP Review Criteria The conditional use p ermit criteria for open and outdoor sale of vehicles is listed below with a review of each. 1. Outside sales areas are landscaped and fenced or screened from view of neighboring residential uses or an abutting residential district. A revised plan a lan needs to be submitted and is subject to review of the Cit y Arborist. There are no neighboring or abutting residential uses or districts. 2. All lighting shall be hooded and so directed that the Eight source shall not be g g visible from the public right-of-way or from neighboring residences. A revised lighting p plan needs to be submitted that does not exceed maximum light intensity level regulations. The light fixture detail submitted is for a full cut- off style fixture. provisions Adequate a e uate and rovisions are made to resolve issues related to demand for services. No use shall be allowed that will exceed the City's ability to provide utilit y, police, fire, administrative or other services to the site. The use will not create a large demand for services. The 4. Th provisions of Section 401.03.A.7 of this Ordinance are considered and satisfactorily met. 4 Se ction 401.03.A.7 are the general considerations for a CUP request. The proposed use is not expected to have a negative impact on the area and is an p ex p appropriate ro riate use provided conditions of approval are met. CONCLUSION AND RECOMMENDATION The proposed land use is appropriate and allowed as a conditional use in the B -2 District. The changes chap es that need to be made to the plans are feasible, and after revisions project are made, the roect will comply with the provisions of the Zoning Ordinance � and Design Guidelines. Therefore, our office recommends approval of the site plan and CUP toallow the new facility for Denny Denn Hecker's ConVersion Van Center subject to the following conditions: permit An access ermit from MnDOT is required for the access onto Neal Avenue North. 2.
