A RESOLUTION ESTABLISI - IING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY JACOB HOLDINGS OF STILLWATER LLC
FOR A CONDITIONAL USE PERMIT TO ALLOW
VAN AND TRUCK SALES AND DISPLAY ON A LOT
ADJACENT TO THE STILLWATER FORD DEALERSHIP
ON NEAL AVENUE BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Jacob
Holdings of Stillwater LLC for a conditional use permit to allow van and truck sales and display
on a lot adjacent to the Stillwater Ford dealership on Neal Avenue and after having conducted a
public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that
the application be approved with conditions. The City Council of the City of Oak Park Heights
makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:
and
reviewing the request; and

3. The subject site is zoned B -2, General Business District in which open and
outdoor sales and display of vehicles is a conditional use; and
4. The subject site was approved in October 2001 for a conditional use
permit to allow ofd site parking for the Stillwater Ford dealership; and
5. The City staff prepared a memorandum dated November 5, 2002
6. The memorandum dated November 5, 2002 recommended that the request
be approved with conditions; and
7. The Planning Commission held a public hearing at their November 14,
2002 meeting, took comments from the applicants and public, closed the public hearing, and
recommended that the application be approved subject to conditions,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The application submitted by Jacob Holdings of Stillwater LLC for a conditional use
permit to allow van and truck sales and display on a lot adjacent to the Stillwater Ford dealership
on Neal Avenue and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject
to the following conditions:
1. An access permit from MnIDOT is required for the access onto Neal Avenue North.
2. Employees of Stillwater Ford shall park on the Stillwater Ford property. Twenty -three
stalls shall be dedicated to customer and employee parking on the subject site. Required
parking stalls shall not be used for display, storage, or sales.
3. Parking stalls are required to be at least 20 feet long with drive aisles that are at least 24
feet wide. A revised site plan, subject to City staff review and approval is required.
4. Revised grading, drainage, and utility plans shall be submitted and are subject to review
and approval by the City Engineer and applicable watershed district.
5 A revised landscape plan must be submitted and is subject to review and approval by the
City Arborist.
6 A revised north building elevation that includes vertical design features to break up the
expanse of wall shall be provided for City staff review and approval.
7 Building material colors shall be provided for City staff and City Council review and
approval. Colors shall be primarily warm tones.
8 A revised lighting plan that complies with the City's foot candle requirements shall be
submitted for City staff review and approval. The fixtures shall be full cut off
9 Elevations for the trash enclosure with materials specifies shall be submitted for City
staff review and approval. Enclosure materials shall be consistent with the principal
building materials.

Information Requirement: The information required for all conditional use permit
applications generally consists of the following items, and shall be submitted when
requested by the City (401.03 -5).

Lapse of Approval
Unless the City Council specifically approves a different time when action is officially
taken on the request, the conditional use permit shall become null and void twelve (
months after the date of approval, unless the property owner or applicant has
substantially started the construction of any building. An application to extend the
approval of a conditional use permit shall be submitted to the Zoning Administrator not
less than thirty (30) days before the expiration of said approval. (401 .03 -7).

Site Plan Review /Design Guidelines Application Process
Application Materials:
Required Approvals:
Plans and drawings are to be submitted in accordance with the processing
requirements for amendments and conditional use permits. (401.03).
Submission materials shall include:
• Site Plan (Existing and Proposed)
• Planting Plan (Existing and Proposed)
• Architectural Plans and Elevations (All exposed sides with material
identification)
• Signage Plans
• Lighting Plans
• Any other plans as requested by City staff, Planning Commission or City
Council
The Planning Commission shall review the submitted materials and make
recommendations on the site and building design elements subject to the
guidelines stated herein. The City Council shall make any final decisions on site
or building design.
