CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY JACOB HOLDINGS OF STILLWATER LLC
FOR A CONDITIONAL USE PERMIT TO ALLOW
VAN AND TRUCK SALES AND DISPLAY ON A LOT
ADJACENT TO THE STILLWATER FORD DEALERSHIP
ON NEAL AVENUE BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Jacob
Holdings of Stillwater LLC for a conditional use permit to allow van and truck sales and display
on a lot adjacent to the Stillwater Ford dealership on Neal Avenue and after having conducted a
public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that
the application be approved with conditions. The City Council of the City of Oak Park Heights
makes the following findings of fact:

1. The real property affected by said application is legally described as

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

3. The subject site is zoned B -2, General Business District in which open and
outdoor sales and display of vehicles is a conditional use; and
4. The subject site was approved in October 2001 for a conditional use
permit to allow off -site parking for the Stillwater Ford dealership; and
5. The City staff prepared a memorandum dated November 5, 2002
reviewing the request; and
6. The memorandum dated November 5, 2002 recommended that the request
be approved with conditions; and
7. The Planning Commission held a public hearing at their November 14,
2002 meeting, took comments from the applicants and public, closed the public hearing, and
recommended that the application be approved subject to conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The application submitted by Jacob Holdings of Stillwater LLC for a conditional use
permit to allow van and truck sales and display on a lot adjacent to the Stillwater Ford dealership
on Neal Avenue and affecting the real property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject
to the following conditions:
1. An access permit from MnDOT be obtained by the applicant for the access auto Neal
Avenue North. A copy of the MnDOT access permit shall be filed with the City offices
prior to work commencing on the site.
2. Employees of Stillwater Ford shall not park on the site (Van Center employees only).
Twenty -three stalls shall be dedicated to customer parking on the subject site. Required
parking stalls shall not be used for display, storage, or sales. Maximum exterior space
parking for vans or display vehicles is 75.
3. Parking stalls are required to be at least 20 feet long with drive aisles that are at least 24
feet wide. A revised site plan, subject to City staff review and approval is required.
4. Revised grading, drainage, and utility plans shall be submitted and are subject to review
and approval by the City Engineer and applicable watershed district.
5. A revised landscape plan must be submitted and is subject to review and approval by the
City Arb or lst.
6. A revised north building elevation that includes vertical design features to break up the
expanse of wall shall be provided for City staff review and approval.
7. Building material colors shall be provided for City staff and City Council review and
approval. Colors shall be primarily warm tones.
8. A revised lighting plan that complies with the City's foot candle requirements shall be
submitted for City staff review and approval. The fixtures shall be full cut off.

9. Elevations for the trash enclosure with material specifications shall be submitted for Cit
staff review and approval. Enclosure materials shall be consistent with the principal
buildin materials.
10. The ori CUP issued b the Cit to use this site dated October 23, 2001 is hereb
vacated. An and all related permits relatin thereto are cancelled.
