meeting of 11/27]01. A notice of the annual review was mailed to the permit b.older.
Direct Staff to Prepare Findings of fact to Revoke CUP
Enclosed with this cover -memo please find an itemization from the Building Official of the violations
that have existed at the site, as well as a summar report froin the Police Cbief that details the existence
of inoperable vehicles present at the site and tb.e remedies attempted throughout this y ear.
As this site has been in violation of the Conditional Use Permit on an ongoing basis with no
permanent remedies made, I recommend that the Cit Council vote to direct staff to prepare a Findings
of fact to revoke the Conditional Use Permit. Tbis findings of fact would be placed on the consent
agenda of 12/27/01.

Re: Karmann Jack's 414621 60 St. N.
On November 28, 2001, 1 conducted a site investigation at the above - referenced
location. At this time, 1 observed violations of the City's 401 Zoning Ordinance and of
the requirements of the Conditional Use Permit granted to Karmann Jacks.
The November 19, 1999 Planner's report, with recommendations, was adopted by the
City Council as part of the Conditional Use Permit granted to the applicant. The
applicant was to comply with the conditions made part of the planning report and
conditional use permit. Item #5 directed that there be no exterior storage of
automobile parts, part cars or related items on the site and that all storage was to be
internal to the building. Any vehicles to be stored outside of the building were directed
to be in full working order.
At the time of my visit to the site, five vehicles remained on site. These vehicles
appeared to be non - operable and either displayed expired registration or no
registration. 1 revisited the site today and found three of the five vehicles removed.
Additional items noted in violation include:
1. A 55- gallon drum, filled with trash, on the lot;
2. Two refuse dumpsters in the lot;
3. Two damaged signs, on the pavement of the parking lot;
4. A damaged business pylon sign, needing repair; and
5. Automobile pans that were once outside a parked vehicle and now remain with
the vehicles removal.

THEIR VEHICLES. ADVISED COOK I WOULD MONITOR THE CLEAN UP
AND WORK WITH HIM ON IT. FOLLOW UP.

Conditional Use Permit to be issued herein affecting the following

Pursuant to Order of the City Council of the City of Oak Park Heights,
a periodic review of this Conditional. Use Permit is imposed as a
condition of its grant. This Conditional Use Permit shall be reviewed
annually at the Direction of the City Clerk, which shall notify the
permit holder of the date of the annual review at least ten (10) days
prior to the review hearing.
