Our Transmission Engineers have reviewed your request for an encroachment for the purpose of
constructing /installing parking/utilities/retaining wail and grading. The encroachment is acceptable to
Xcel Energy under the following conditions:

A minimum distance of 26 feet of supported earth must be maintained from the legs of the tramission
line lower at the current grade. Support of the ground beyond the 26 feet may be provided by a slope
no greater than three (3) feet horizontal to one (1) foot vertical. Support may also be provided by the
use of cribbing, shoring, sheet piling, retaining wall or tunneling., The specific plan for providing the
required support and the excavation plan for the proposed project must be submitted to Xcel Energy
for review and approval.
2, GRADE CHANGE AROUND TH E STRUCTURE LOCATION
Fill around or above steel structure foundations is not permitted. The grade around the structures must
provide for surface water runoff; no surface water ponding around structures will be punted. Any
cost related to the adjustment of Xcel Energys facilities will be at the requestors expense.
3 GRADE CHANCE WITHIN EASEMENT

The ground elevation within the easement shall not be increased more than 2 feet above the existing
grade. Stockpiling of soil and /or material within the easement will not be permitted.
4 CLEARANCES TO EOUIPMENT AND WORKERS
A working clearance of 25 feet between the electrical conductors and any cranes or digging equipment
used in or near the easement must be maintained at all times. in addition, any construction near the
transmission line(s) shall comply with all OSHA Safety Clearances. If this clearance cannot be

recorded as Document Nos. 34402 and 255097 shall remain in full force and effect.
To acknowledge receipt of and agreement with the terms of this consent prior to commencing any
activities within Xcel Energy's easement, please sign and return a copy of this letter to me in the

a. Temporary shoring systems used for excavations shalt be designed by a
professional engineer licensed in the State of Minnesota. Shoring system
plans and calculations shalt be signed by the professional engineer and
submitted to Xcel Energy for review and approval.
C. Retaining wails shall be constructed of permanent, engineered, non -wood
materials and shall be designed by a professional engineer licensed in the
State of Minnesota. Retaining wall plans and calculations shall be signed by
the professional engineer and submitted to Ice' Energy for review and
approval,
D. Retaining walls shall be properly designed and maintained to hold soils
supporting lattice tower foundations.
E. Grades around lattice towers shall be property maintained to prevent erosion of
soils from the area,
F. Submit all final project plans to Xcel Energy for review and approval.
