Held: Monday, September 11, 2000
Pursuant to due call and notice thereof, a regulars scheduled meeting .

for the City of oak Park Heights, Washington County, was s duly held at the Oak Park
Heights Municipal Building, 14168 Oak Park Boulevard within said municipality on the 11 day of
September, 2000, at TOO o'clock p.m.
The following members were present:
Schaaf, Beaudet, Byrne, Turnquist
and the following were absent:
Swenson

RESOLUTION TO VACATE PERPETUAL EASEMENT LOCATED
WITHIN OUTLOT B OF VALLEY VIEW ESTATES LYING NORTH
OF
THE NORTHERN RIGHT -OF -WAY LINE OF UPPER 56 STREET
NORTH AND SOUTH OF THE SOUTHERN RIGHT-OF-WAY LINE
OF 57' STREET NORTH AS WAS PREVIOUSLY CONVEYED AND
ACQUIRED BY THE CITY OF OAK PARK HEIGHTS BY
DOCUMENT NO. 1 028280 AS FILED AND OF RECORD IN THE
OFFICE OF THE REGISTRAR OF TITLES IN AND FOR
WASHINGTON COUNTY, MINNESOTA
WHEREAS, the City Council has received the recommendation of its staff
recommending the vacation of a public right-of-way previously acquired b the City . y q y of oak Park
Heights as said right-of-way is to be entirely located within outlot B of Valle View xew Bstates, said
right -of -way being previously acquired as Document No. 1028280 and filed in the office of the
Registrar of Titles in and for Washington County, Minnesota• 7 and
WHEREAS, it is the intent o the City of yak Park Heig only t
g y o vacate said
right -of -way as it affects road right-of-way purposes and then onl as to that portion of the right -of-

way that is located south of the southern right-of-way of 57 Street and north of
� the northern right-
of -way of Upper 5 Street North; and
WHEREAS, it appears to be in the best interests of the p ublic to v acate said
easement as aforesaid; and

WHEREAS, the City has duly conducted public hearings and has received . g no
adverse public comment with regard to the vacation of the ro osed area to be v •
P p vacated; and
unused; and
WHEREAS, said right -of -way affected by the request to vacate is unopened q p d and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That all that part of that dedicated right-of-way located within Outlot
B of Valley View Estates being specifically referenced within Document
No.
1028280 and as filed of record in the Office of the Registrar of Titles in and

Washington County, Minnesota and located within said Outlot B south of the
southerly right-of-way line of 57 0 ' Street and north of the northerly lin

pp 6 Street North with a center line of said unopened rig ht-of-way bein g
described as follows:

The center line of said perpetual easement is " described as beginning at a
point on the west line of said Tract I, Registered Land Survey No. 69,
Washington County, Minnesota, distant 450.27 feet south fi°om the northwest
corner thereof, said west line has an assumed bearing of South 2 degrees 12
minutes 40 seconds East; thence North 89 degrees 26 minutes 36 seconds
East 90.59 feet; thence easterly, northeasterly and northerly 155.41 feet
along a tangential curve concave to the northwest having a central angle of
91 degrees 39 minutes 16 seconds and a radius of 97.1 S feet; thence North 2
degrees 12 minutes 40 seconds West and tangent to said curve 64.78 feet to
the south right -of -way line of 57 Street North as dedicated in Sun View
Addition according to the recorded plat thereof and said center line there
terminating.
is hereby vacated as and for use for public street purposes.
2. That all such right -of -way so vacated is vacated exclusively for
public roadway and street purposes only and that all other easements inclusive of
drainage and utility easements belonging to the City of Oak Park Heights are
specifically retained hereby and are not vacated hereby.
3. That the City Administrator shall prepare a notice of completion of

these proceedings which shall contain the name of the city, the identification of
vacation, a statement of the time of completion thereof, and a description of the real
estate and the land affected thereby. Such notice shall be presented to the Coup
. ty
Auditor /Treasurer who shall enter the same in its transfer records and note upon the
instrument over his official signature the words "Entered in the transfer records ".
The notice shall then be filed with the County Recorder of Washington . � County,
Minnesota, all as required by Minnesota Statute §412.85 1.
Adopted by the City Council for the City of oak Park Heights this 1 I th da y of

NOTICE OF COMPLETION OF VACATION PROCEEDINGS
To: The Office of the Washington County Auditor/Treasurer
PLEASE TAKE NOTICE that the City of Oak Park Heights has
completed proceedings for the vacation of the following described (unopened) street as
located within Outlot B of Valley View Estates, the same being legally described as
follows, to wit:
That part of that dedicated right -of -way located within Outlot B of Valley
View Estates being specifically referenced within Document No. 1028280
and as filed of record in the Office of the Registrar of Titles in and for
Washington County, Minnesota and located within said Outlot B south of the
southerly right -of -way line of 57` Street and north of the northerly right -of-
way line of Upper 56` Street North with a center line of said unopened right-
of -way being described as follows:
The center line of said perpetual easement is described as beginning
at a point on the west line of said Tract I, Registered Land Survey

purpose of the vacation proceeding was to vacate said right-of-way r roadway purposes

only. The City specifically retained all other easements for drainage, utility and /or

municipal easements as are in place over the affected property.

RESOLUTION TO VACATE PERPETUAL EASEMENT LOCATED WITHIN
OUTLOT B OF VALLEY VIEW ESTATES, LYING NORTH OF THE
NORTHERN RIGHT -OF -WAY LINE OF UPPER 56 STREET NORTH AND
SOUTH OF THE SOUTHERN RIGHT -OF -WAY LINE OF 57 STREET
NORTH AS WAS PREVIOUSLY CONVEYED AND ACQUIRED BY THE CITY
OF OAK PARK HEIGHTS BY DOCUMENT NO. 1028280 AS FILET) AND OF

WHEREAS, the City Council has received the recommendation of its staff

said right -of -way being previously acquired as Document No. 1028280 and filed in the office of
the Registrar of Titles in and for Washington County, Minnesota; and
WHEREAS, it is the intent of the City of oak Park Heights only to vacate said right-of-
way as it affects road right-of-way purposes and then only as to that portion of the right-of-way
that is located south of the southern right-of-way of 57 Street and north of the northern th right-of-
way of Upper 56 Street Forth; and
WHEREAS, it appears to be in the best interests of the public to vacate said easement as
aforesaid; and
WHEREAS, the City has duly conducted public hearings and has received no adverse
public comment with regard to the vacation of the proposed area to be vacated; and
WHEREAS, said right-of-way affected by the request to vacate is unopened and unused;
and
Now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:

Adopted by the City Council for the City of Oak Park Heights this day of
