RECOMMENDING TO THE CITY COUNCIL T:IIAT THE
REQUEST BY LOW'S HOME CENTERS FOR A
CONDITIONAL USA PERMIT TO ALLOW OPEN AND OUTDOOR
STORAGE UT TRUCK TRAILERS TO ENCLOSE PALLETS
AND USED APPLIANCES, AND T4 ALLOW THREE DELI
TRUCKS TO BE PARKED WITHIN A STORAGE AREA ON THE
SOUTH SIDE OT THE LOWE'S STORE, LOCATED AT
5780 NOVA SCOTIA AVENUE NORTH
SHOULD BE APPROVED WI1'FI CONDITIONS
WHEREAS, the City r of Oak Park H eights has received a request from Lowe's
Home Centers for a conditional use permit to allow open and outdoor storage of truck tra.11ers - to
enclose pallets and used appliances, and to allow three deliver' trucks to be parked within a
storage area on the south side of the Lo e's store, located at 5780 Nova Scotia Avenue North;
and after having conducted a public hearing relative thereto, the Planning Commission of oak
Park ig is makes thefollowing findings of Fact:

documentation to the Community Development Department consisting of the ollo ing items:

3 . Approval of the PUD General Plan or the Lowe's Store was granted b
the City Council on November 22, 2006; and
4 . The property is zone B-4, L imited Business ,district in which open and
outdoor storage is a listed conditional use; and
5 . City staff prepared a planning report; dated June 6, 2007 reviewing the
request for open and outdoor storage of truck trailers and delivery trucks; and
6. City staff reeona ended in the June 6, 2007 plaiining report that the
request be approved with conditions; and
7. The Planning Commission held a public hearing at their June 14, 2007
me ting, tools comments from the applicants and public, closed the public hearing, and made the
following recommendation:
NOW, THEREFORE, BE IT RESOLVEI) 13Y THE PLANNIN(I
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submit ed by fo e's Home Centers for a conditional use permit to allow
open. and outdoor storage of truck trailers to enclose pallets and used appliances, and to allow
three delivery trucks to be parked within a storage area on the south side of the Lowe's Low ' store,
located at 5780 Nova Scotia Avenue North and affecting the real propert y as follows:

and the same as hereby recommended to the City Council of the City of Oak Park Heights for
approval r{oval with the following, conditions:
All outdoor storage of truck trailers, box trucks, and flat bed trucks shall be within the
areas indicated in th site p dated June 4, 2007. No niore than two trLick trailers and a
total of three delivery trucks shall be stored at one Wale.
2. The berming, landscape and - fencing plans shall b e sup ject to review and approval of the
City l = �ri it eer, City Arborist and City Planner.
3. No merchandise or storage items sha b e stored above the gardeii center fence on the
west side.of the building.
4. Merchandise within the fence storage area on the southeast side of the building shall be
screened so that it 1s not visible from Nova Scotia Av enue. "I' he applicant shall provide a
sc reening plan subj to review and approval o the City Planner.
Recommended by the Planning Commission of the C of Oak Park Heights this 14"' day

Conditional Use Permit - Lapse of Approval:
Unless the city council specifically approves a different time when action is officially
taken on the request, the conditional use permit shall become null and void t welve 12
months after the date of approval, unless the property owner or applicant has
substantially started the construction of any building, structure, addition or alteration, or
use requested as part of the conditional use. A application to extend the approval of a
conditional use permit shall be submitted to the Zoning Administrator not less than thirty
( 30) days before the expiration of said approval, (401.03.C. 4.a and b)
