The subject property is located within the NWI/4 of the NE1/4 of Section 5, T29N, R2OW, Washington County. The subject property is also described as Lot Two (2), Block One (1), Wal-Mart Addition, Washington County, Minnesota. Included in this report is wetland permitting documentation to assist you in complying with the Minnesota Wetland Conservation Act (WCA) and Section 404 of the Federal Clean Water Act, which is administered by the U.S. Army Corps of Engineers (COE). The subject parcel is approximately 1.24 acres. According to historical aerial photographs, the subject property was graded in 1970 and has experienced occasional grading activities since then as the neighboring properties were developed. This report describes the characteristics of the wetland basins and documents their status under the various wetland regulations. If your project will not impact the wetland, or is below the threshold limits outlined below, this report can be submitted to the regulatory authorities to document compliance. If wetland impacts are proposed as part of your project, additional documentation, applications and plans may be necessary. WAND DELINEATION METHODOLOGY MFRA reviewed the available ackgroun wetland information of this site as a part of the wetland delineation activities, which included: • Washington County Soil Survey (April 1980); • National Wetlands Inventory Map (NWI); • DNR : Public Waters Map; and • aerial photographs (1938 -. 2008). Washington Co n y Soil Survey Hydric soil is an indicator of potential wetland conditions. Although much of the site has been altered since the soli survey was completed, the Washington Copy Soil Survey was reviewed to identify the m_ p ed soils of the project site prior to the site improvements. This information is useful in fetter understanding the site conditions prior to site improvements and if the natural soils were indicative of wetland conditions. According to the soil survey, the site exhibits two different soil map units, which include: Antigo silt loam (49) and Crystal Lake silt loam (449). Neither of the soil map units is classified as a hydric soil. Furthermore, the Crystal Lake silt loam is classified as a moderately well drained soil and the Antigo silt loam. is classified as a well drained soli. National Wetland nventory NWJ maps are utilized as an off-site tool in identifying areas of oten .tial wetlands. These maps were generated in the early 1980's using high altitude color infra -red aerial photos viewed through stereoscopes. The NW]: map does not identify any potential wetlands o n the subject property or near the project boundaries. DN Public Waters DNS. Public Waters are water o ies which meet the definition of Minnesota Statue 103G.005, Subdivision 15 and are regulated by the DNR. The DNR Public Waters Map of Washington County does not illustrate a DNR Public Water within the project limits. Field Delineation The subject property was field delineated using the principles of the 1987 Corps of Engineers Wedand Delineation Manual including adopted modifications, guidance letters Mr. Kenneth Plaski October 28, 2008 Page and memoranda o agreement. The routine in .tio . method was used and omin nt vegetation was evaluated by estimating area cover and the 50/20 rule. Wetlands were classified according to the methodologies in Wetland and Deepwater Habitats ofthe United States FWS O S Publication 79/31; Cowardin et. al. 1979) and Wetlands of the U States (USFWS Circular* 9; Shaw and Rodin 1971) Wetland boundaries were staked with pink "Wetland Boundary" pinflags. The sample point location is indicated on each data sheet. MFRA utilized a Trimble eoXI-1 to locate the wetland boundaries. The located wetland boundaries are illustrated on the attached Wetland Delineation Exhibit. BASIN CHARACTERISTICS Two wetlands were identified and staked during the October 17, 2008 site visit. Wetland 1 is located within the right-of-way of 60 Street North. The linear shape and relatively steep sidesio es suggest that Wetland 1 was man-made. The presence of concrete culverts at each end of the wetland suggests that the wetland is utilized to store and transport stormwater from the nearby sites, which is also the primary source of hydrology supporting the wetland. The topographic map indicates that the wetland slopes /drains toward the west. The 1980 aerial photo illustrates disturbance over a majority of the subject property. The 1 992 aerial photo illustrates disturbance the subject roper y and the neighboring property to the south (Wal-Mart site). Aerial photos between 1997 and 2006 illustrate the subject property as it currently exists. One transect, consisting of two sample locations, was established along the south side of Wetland 1. Dominant vegetation and wetland hydrologic ndicators were observed and noted at each sample location. Soil borings were not completed for Wetland 1 due to the presence of underground utilities in the vicinity. Data collected from the sample locations are presented teed in the Field Data Sheets (SP I -1 WET and S ] 1- UP), which are included with this report. Cattail is the dominant vegetation within Wetland 1. The boundary of Wetland 1 was based on the abrupt change in elevation and the dominance of smooth brome, Kentucky bluegrass, and Canada goldenrod along the landwa rd side of the boundary. Wetland 2 is classified as an isolated, Palustrine type wetland exhibiting Emergent vegetation and a Seasonally Flooded moisture regime or a Type (PEMC) wetland. According to the Washington County Soil Survey, the wetland is located in an area mapped as Crystal Lake silt loam (449), which is classified as a moderately well drained, nog -hydr c soil. The NWI map does not identify a potential wetland in the vicinity of Wetland 2 and the DNR Public Waters Map for Washington County does not illustrate Wetland 2 as a DNR Public Water. Wetland 2 is located along the western property boundary and captures stormwater runoff from the adjacent property to the west. The relatively linear shape and steep sideslopes suggest that Wetland 2 was manmade for the purpose of ponding stormwater. The wetland appears to be hydrologically supported by stormwater. The historical aerial photos do not indicate a wetland in the vicinity of Wetland 2 prior to disturbance. Therefore, it appears that the wetland was incidentally created due to s s r • • previous grading activities. Wetland Jurisdiction. Clean Water Act, Section 4.04 The U.S. Army Corps of ngine ors C regulates dredge and fill activities in navigable waters, wetlands adjacent, tributary, or with significant nexus to navigable waters and isolated wetlands important to interstate commerce. A 2001 Supreme Court ruling limited the COE jurisdiction over isolated wetlands. Based, on site observations, it is apparent that Wetland 2 is isolated and therefore not COE jurisdictional. Wetland 1 is located within the right-of-way of 60 Street North and appears to flow ()lithe subject property to the west. It is apparent that surface water flows off of the site, however it is unknown if this surface water makes its way into a Water of the United States. Therefore, MFRA recommends that a copy of this report be submitted to the COE for an official COE jurisdictional wetland determination. In most cases, if the proposed impacts are less than 400 square feet, the COE does not require noti ration of the project. If the proposed impacts are between 400 square feet and 2. 0 acres, the COE requires notification and approval (letter of permission) prior to beginning the project. If the wetland _ impacts occur in or adjacent to "special waters" and or exceed 10,000 square feet, the COE review will include a 30 -day public/interagency notice. If the proposed impacts exceed the WCA cue Mini/WS limits (see below), the COE will require mitigation for the full amount of the impacts regardless of the WCA exemption. If more than two acres of wetland impacts are proposed, an individual permit will automatically be required which includes sequencing (proving there are no alternatives), review by other environmental agencies, a public comment period, and compensatory mitigation. The WCA allows a de minim is exemption of 100 square feet of wetland impacts to Type wetlands outside of a building setback zone or 20 square feet for Type wetlands within the building setback zone. Wetland 1 is classified as a Type wetland. Therefore the de illini112 1,5 exemption for Wetland would be 100 square feet if the wetland is determined to be COE jurisdictional. If the proposed wetland impacts exceed 100 square feet then replacement will be required for all impacts to Wetland 1. The DNR also regulates activities in some rivers and streams and., as of December 1994, any tributaries to DNR designated trout streams. The DNR has jurisdiction over areas below the Ordinary High Water level ORW . The OHW for a lake or wetland is determined by the DNR as the elevation at which the vegetation changes from aquatic to terrestrial. For a watercourse, the OHW is the average elevation of the top of the chann l banks at any iven location. The DNR Public Waters map for Washington County does not identify any DNR Public Waters within t he project boundaries. The DNR contact for this region is Craig Wills (651) 259-5757. Minnesota Wetland Conservation Act (WCA) A Local Government Unit GU will have jurisdiction over the wetland on the site, based on the WCA as amended through 2000. The WU for this site is the City of Oak Park Heights. Bonestroo (Ben Meyer, 651.-604-4767) administers rs th WCA o behalf of the City of Oak Park H eights. The WCA regulates impacts (filling or draining) ng to wetlands within the State of Minnesota. All land development projects within the state are required to demonstrate avoidance and minimization of et and impacts. Replacement ent (mitigation) of unavoidable wetland impacts is required.. The location of the replacement wetland(s) shall be base d on the wetland replacement sequencing process of the WCA. On-site replacement is the :o priority in retland itigation. Off-site wetland mitigation is allowed if on -site mitigation is not deemed possible. Off-site mitigation should be completed as close to the project site as possible. An alternate method of off-site mitigation is to purchase wetland credits from a hoard. of Water and Soil Resources (BWSR) approved wetland bank site. The WCA includes an exemption for the replacement o incidental wetlands. According to this exemption, wetlands that were created in a non-wetland environment for the purpose other than to create a wetland are considered incidental and the replacement for impacts that occur to these wetlands is not required.
