A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION off` THE CITY COUNCIL THAT THE
REQUEST BY M & I BANK FOR A SITE PLAN REVIEW, DESIGN
GUIDELINES REVIEW, AND A VARIANCE TO ALLOW A THIRD
BUILDING 'BALL SIGN FOR A FULL SERVICE DRIVE-UP BANKING
FACILITY ON LOT 2, BLOCK 1, AL- ART ADDITION
BE APPROVED WITH CONDITIONS
WHEREAS, the City of oak Park Heights has received a request from M & 1
Bank for a site plan review, Design Guidelines review, and a variance to allow a third building
gall sign for a full service drive -up banking facility on 1.ot 2, Block 1, al -Mart Addition; and
after having conducted a public hearing relative thereto, the Planning Commission of Oak Park
Heights recommended that the request be approved with conditions, The City Council of the
City of Oak Park Heights makes the following findings of fact and resolution:
1. The real property affected by said application is legally described as

7. The Planning Commission held a public hearing at the October 9, 2008
meeting, took cornments from the applicants and public, closed the public hearing, and
recon emended that the application be approved with conditions.
NOW, THEREFORE, BE IT RESOL BY THE CITE' COUNCIL FOR
THE CITY of OAK PARK 14FIGHTS THAT THE CITY COUNCI L APPROVES THE,
FOLLOWING:
A. The application submitted by M & I Bank for a site plan review, Design Gtiidel ines
review, and a variance to allow a third b��ild ng wall sign fir a fell service drive- banking
facility on Lot 2, Block. 1, Wal - Mart Addition and affecting the real property as follows:

]"he City Council of the Cite of Oak Park I.- Ieights approves the site plan review, the Design
GuideliDes review, and the variance for the third wall sign sul�jecrt to the following findings of
fact for the third wall sign variance:
1. 'f'lie applicants have proposed a total of thr wall signs, each on dif -erent facades of the
bLillding.
2. "the total square footage of each sign is less than 3 5 ,scl Lure feet: or a tota of d le ss than 65
square feet.
3. "I'he third wall sign ensures visibility of the bank and drive-through from both east and
west bound traffi on I l i ghway 36.
Ile and the same as hereby approved by the City Council of the City of Oak Park Heights with
the following conditions:
1. The site plan (C -3.01A) indicates the first drive --in unit has 174 f eet of stacking, and [lie
second drive --in unit has 198 feet of stacking. 'here is no indication of the stacking space
for the third drive -in Unit. Clarification should be made regarding the stacking space.
2. The stall depth and aisle width do not meet the minimum requirements for parking stalls
that are at a 60 degree angle and 9 feet, G inc wide. Adjustments shall be made to the
parking area in order to meet the Ordinance requirements.
3. The applicants at their expense shall construct an east - west trail along the north edge of
their property as general demonstrated on their stibm i tted site plan and shall also
provide a connection from the trail to the site/building.
4. A revised Photometric Plan shall be submitted that indicates the foot candle readings to
the center line of 60 "' Street North to determine that the intensity requirements are niet.
S. Outdoor lighting for the parking areas shall be turned off one hour after Closing, except
for approved security lighting.

6. The Landscape Plan shall be subject to the review and approval of the City Ar•borist.
7. The City Councll was not favorable to the non - cutoff decorative fixtures for the front
entrance. 'The applicant may install fixtures at this location but only if full cut - off.

9. The Ordinance only allows two directional signs that d o not count towards the maxIMUM
allowable sign area as long as they do not exceed twelve squa- i feet, Therefore only two
of the four proposed directional si Yns shall be allowed.
1 The Grading, Drainage, and Erosion Control Plan shall be sul�j cct to the review and
approval by the City Engineer.

timing of that improvement shall be coordinated with the burying of distribution lines in
front of Lowe's along 60"' Street North, `I"'he applicant shall escrow sufficient funds, 'is
specified by the City Engineer, to complete the improvement or agree that the City will
complete the work and petition for the public iniprovenient, waiving notice of public
hearing; and assessments, as required under Minnesota Statute 429.
