HomeMy WebLinkAbout2005-12-13 CC Resolution #2005-12-58and and RESOLUTION NO. 2005 -- 12 W- 58 CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY VSSA FOR A CONDITIONAL USE PERMIT TO MOVE A SCHOOLHOUSE STRUCTURE TO THE HISTORIC VILLAGE SITE ON THE BOUTWELLS LANDING CAMPUS BE APPROVED WITH CONDITIONS WHEREAS the City of Oak Park Heights has received a request from VSSA. for a conditional use permit to move a schoolhouse structure to the Historic Village site on the Boutwells Landing campus; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the request be approved with conditions. The City Council makes the following findings of fact and resolution: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B 3, VSSA has requested a conditional use permit to move the historic schoolhouse as soon as possible to protect the integrity of the structure. 4, The subject property is zoned PUD, Planned Unit Development District in which the proposed uses are permitted; and 5. The City staff prepared a planning report dated November 30, 2005 reviewin g the request for a conditional use permit; and 6. The November 30, 2005 planning report recommended approval of the conditional use permit subject to the fulfillment of conditions; and 7. The Planning Commission held a public hearing at their December 8, 2005 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the application be approved with conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAS PARK HEIGHTS THAT THE CITY COUNCIL RECOMMENDS THE FOLLOWING: A. The gene. plan p general plan of development is approved for the Historic Village site on the Boutwells Landing campus. 2. Upon relocation, ocation the building shall comply with the applicable requirements of the Uniform Building Code subject to approval of the City's Building Inspector. 3. A performance security is provided to the City as specified in Section 401.08 of the y p Ordinance. 4. The relocated ed structure is ready for occupancy within eight months from the date of location on the site or as required by the City Council. 5. Approval of a grading plan by the City Engineer. 6. Submittal p l of a transportation plan showing the route for moving the structure and a permit from Washington County for movement on County roads. pp 7. Review and approval from Xcel Energy concerning clearance for movement beneath power lines. $ .
