To date the City has not accepted any of this installed infrastructure including roads, utilities, sidewalks, etc. This acceptance is typically done in the form of a resolution by the City Council and a formal acknowledgement of some form. However, prior to any final acceptance the City would need a final verification from its engineer that all elements are complete and in an acceptable condition. Accordingly, there appear to be remaining issues, although small, that will not be able to be addressed until this spring - including remaining storm sewer cleaning, final sidewalk construction and some street paving issues. Once complete the City will then contemplate a formal acceptance. In the interirn however, the City will accept the typical snowplowing responsibilities at this time for the Streets Only, namely Nolan Parkway and Nolan Lane —but does not include sidewalks, driveways or other private streets. This responsibility will be assumed by the City at 12:01 a.m. on January 15 2005. Effectively any snowplowing efforts incurred by Raleigh Trucking will be billed to the City as of that date and under the terms as stipulated in our contract with them. It is important to note that there are remaining issues with the final asphalt lift that still need to be corrected and which could be damaged during the plowing season. The City will not be responsible to repair this damage. This potential damage, as well as any other damage that may have already occurred due to plowing or due to other reasons will have to be assessed and corrected prior to the City accepting the roadway.
