HomeMy WebLinkAbout2006-01-xx CC Resolution #06-01-08WHEREAS, the City of Oak Park Heights entered into a Developers Agreement
with V.S.S.A. McKean West, L.L.C. in May of 2003 specifying certain public improvements to be
constructed in the development as specified for within that contract; and,
WHEREAS, the City's consulting engineers, Bonestroo, Rosene, Anderlik &
Associates, have certified to the City that the project was substantially complete as of November
18, 2005 and that the project is ready to be completed and finalled out at this time; and,
WHEREAS, the warranty period otherwise called for within the Developers
Agreement will be effective commencing November 18, 2005; and,
WHEREAS, under the terms and provisions of the Developers Agreement the
City's consulting engineer was provided the construction management and coordination function
and assigned the task of advising the City Council as to when the project was substantially complete
for purposes of establishing warranty commencement and related obligations.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of
Oak Park Heights that the Plan B Improvements otherwise specified within the aforementioned
Developers Agreement be and the same are hereby formally accepted by the City of Oak Park
Heights and all public improvements noted therein hereby become the property of the City of Oak
Park Heights.
