A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY WASHINGTON COUNTY FOR RELOCATING CERTAIN
CITY UTILITIES BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from
Washington County to relocate certain City utilities in conjunction with the Washington County
2025 Campus Plan, 2007 -2008 improvements; and,
WHEREAS, the City and Washington County on October 4 2005 entered into
an agreement directing the development of certain elements of the Washington County
Goverrunent Center; and,
WHEREAS, the October 4 th 2005 agreement expressly requires that no City
utility lines or services currently serving the Campus area may be removed, relocated or altered
• without the written consent of the City; and,
WHEREAS, the subject site (the Washington County Government Center
Campus), lies in the City of Stillwater but is served by utilities owned and operated by the City
of Oak Park Heights; and,
WHEREAS, the City Engineer prepared a report, dated July 5 2007, reviewing
the request and making certain recommendations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The proposal submitted by Washington County to relocate certain City utilities in
conjunction with the Washington County 2025 Campus Plan, 2007 -2008 improvements.
Be and the same as hereby approved by the City Council of the City of Oak Park Heights with
the following conditions:
I. The County shall convey to the City all easements as may be required by the City
Engineer to ensure that the City's water, sanitary and storm systems remain properly
located in the City's easements as well as remain secure, intact and operational. Should
future maintenance or rehabilitation be required, the City shall not be responsible to
• restore these easement areas. It shall be the County responsibility to restore curbing,
asphalt, landscaping or other elements that may be impacted. Should the City require
relocation of any lines that may be rendered inaccessible by the County's other facilities,
the County shall convey to the City at no cost the necessary easements that may be
• required by the City Engineer that ensure the City's water, sanitary and storm systems
remain secure, intact and operational.
2. The County and the City shall identify and convey all required easements necessary for
all utility installations, relocations or improvements on or before project completion.
3. The final storm sewer layout shall be consistent with Option 3 as proposed by the City
Engineer in his July 5, 2007 Memorandum, amending the County's initial submission.
Construction documents shall be revised by the County to reflect these changes. Final
plans and improvements shall be subject to the final review and approval of the City
Engineer. The City Engineer's review memorandum is affixed to this resolution as
Exhibit A.
4. The County shall install (and subsequently own), repair and provide all maintenance for
the proposed 36" stormwater main contemplated in Option 93 designed to serve the both
the Washington County campus as well as other surrounding areas, both public and
private. The County shall transfer all current flows and drainage patterns currently being
served by in -place stormwater infrastructure to this new 36" stormwater main. The
county shall not charge any fee for this service to any contributing property.
5. The County shall permit the City to connect (without fee) to the new 36" stormwater
main a catch -basin/ lateral that will drain certain areas lying northeast and directly
• adjacent to the County campus, 62 Street and Beach Road. Such plans shall be drawn
by the City Engineer and installed as an addendum to the Washington County project.
The City shall pay for the related engineering and installation costs.
6. In the event of future maintenance, replacement or updating of County owned utilities,
the County shall be required to restore any impacted City infrastructure and streets to an
equal or better condition.
7. The County shall also provide Construction documents detailing of the relocation of the
City's water main pressure reducing station from its current location south of the
Government Center to the east side, as previously discussed with City staff. Final plans
and improvements would be subject to the final review and approval of the City
Engineer.
8. The County shall verify the operation of all existing valves, joints and fittings used for
water and sewer control. Any materials or fittings re -used in the implementation of the
project shall be new or re -built to an as new condition. This includes gate valves,
pressure reducing valves and structures used in conjunction with relocation of the
pressure reducing station. All new and reused materials for the water system shall be
tested and sanitized to AWWA new pipe standards and be inspected and verified by the
Oak Park Heights Utility Department prior to exposure to the City of Oak Park Heights
water supply. The City of Oak Park Heights Public Works Director shall be the final
is authority regarding the water system use and transition requirements.

9. For this project the City shall require that all project impacted City streets and right-of-
ways shall be restored by the County to an existing or better condition and may not be
widened unless and until first approved by the City Council.
10. The County shall agree to pay for fifty (50) percent of the reconstruction of 62 Street
North and Paris Avenue North to the City Standard in effect of the time of the
reconstruction, including all required concrete curb and gutter. This shall only include
that portion of 62nd Street N. lying between Panama Ave. N. and Paris Ave. N., that part
of Paris Ave. N. lying south of 62 Street N, and the intersection of 62 St. N. & Paris
Ave. N.. The timing of this reconstruction shall be determined by the City.
11. At such time when the City extends a trail or sidewalk that abuts the Washington County
campus, the County shall install and connect the necessary trails and sidewalks to ensure
that there is linear and aesthetic continuity between the County and City trails and
sidewalks.
12. The County shall cause all current and proposed campus lighting to be retrofitted to
comply with the City of Oak Park Heights lighting standards not later than December
31 2010.
13. The County shall provide full `as- built' drawings to the City in both digital and hard copy
format of all constructed and abandoned public facilities for the entire campus. Digital
drawings shall be in an appropriate Washington County coordinate system.
• 14. The City Arborist shall determine if there are trees to be removed that actually lie within
the City. If there are trees that lie in the City and are to be removed, the County shall be
required to restore such trees within the City or shall pay into the City tree replacement
fund as required by the City tree replacement Ordinance 1307. The County shall
complete in a timely fashion all site landscaping and in accordance with the plans as
submitted and approved by the City Arborist.
15. All temporary parking and staging areas shall be immediately paved so as to minimize
dust and noise. All other ponds, landscaping and site restoration elements shall be
completed in a timely and orderly fashion as required by the City Engineer and the City
Arborist.
16. The County shall pave, but not expand, the currently unpaved roadway accessing the
County facilities from Paris Ave. The County shall install a card - access gate to monitor
and control unauthorized use of this roadway. This access shall remain a secondary
access consistent with the October 4 2005 agreement.
17. The County shall secure a Middle St. Croix Water Management Permit, a copy of such
permit shall be provided to the City.
18. The County shall enter into a Development Agreement with the City of Oak Park Heights
. that shall incorporate the approvals and conditions as set -forth herein subject to the final
review and approval of the City Attorney. No work may commence by the County until

such time as a satisfactory Development Agreement is signed by both the City and
• Washington County.

Reconstruction on 62nd Street N. and Paris Avenue N.
Eric:
As directed, we have reviewed the issues associated with three different options for the
alignment of the storm sewer on the Washington Country Government Center expansion
project. Following is a description of each alignment option and the construction issues
associated with each one. Each of the three options is hand - sketched on a large topographic
survey map that will be available for the Council Meeting on 7/10/07.
Alignment Descriptions:,
OPTION 1
Option 1, which is the County's proposed alignment, is hand -drawn in pink on the survey map.
For the majority of this option the storm sewer alignment is in pervious areas paralleling 62
Street North and Paris Avenue North. The only portion in the street is approximately 160 feet in
• 62nd Street N. adjacent to the existing residence on the south side of 62nd Street N.
OPTION 2
Option 2 is hand -drawn in orange on the survey map. The alignment for this option keeps the
storm sewer under existing streets for its length. It would run in 62nd Street N. from Panama
Avenue N. to Paris Avenue N (basically under the existing southerly bituminous curb line). At
the intersection of 62nd Street N. and Paris Avenue N. the storm sewer heads south in Paris
Avenue N. for approximately 960 feet to its terminus (the alignment here is in the centerline of
Paris for the first 225', then under the westerly bituminous curb line for the remainder of the
way). From this location it angles southwest across green area to connect to the existing storm
sewer system.
OPTION 3
Option 3 is a combination of Option 1 and Option 2. The attached survey map labels Option 3
along the alignment of Option 1 and Option 2. The alignment for Option 3 is included as a
compromise to place as much storm sewer under city streets as possible yet minimizing
impacts to existing utilities /power lines. In comparison to Option 1 it has an additional 150 feet
and 225 feet of storm sewer in 62nd Street North and Paris Avenue North, respectively. In
Option 1 this 375 feet of storm sewer is located in the boulevard.
Construction Issues:
OPTION 1 (Countv's aliqnment)
• Removal of numerous trees:
• Approximately 35 trees on County property (26 south of 62nd Street N. & 9
west of Paris Avenue N.)
• Approximately 12 trees on City property (1 adjacent to residence on south
side of 62nd Street N., 11 along west side of Paris Avenue N.)
• Road closure /disruption adjacent to residence on south side of 62nd Street N. affecting
access. Replace existing roadway section in kind.
• Overhead utility lines /poles need relocating (along Paris Ave N. Slo of Upper 61 st St.
N)
• Crossing under overhead power lines (adjacent to residence on 62^d Street N.).
OPTION 2 (Under streets)
• Removal of trees:
• Approximately 6 trees on County property (south side of 62nd Street N.)
• Approximately 2 trees on City property (near County access road entrance)
• Road closure /disruption for all of 62nd Street N. and Paris Avenue N.
• Reconstruction of bituminous roadways to 28' wide with concrete curb and gutter. in a
recent analysis an estimate was performed to determine the cost for the reconstruction
of 62nd Street N. and Paris Avenue N. (Option 2). This estimate included widening
these two streets from 24' to 28' wide and concrete curb & gutter per the City's
previous street reconstruction feasibility report. The total construction cost was
• estimated at $240,000 (not including engineedng/legal /admin.).
• Overhead utility lines /poles need relocating (along the majority of Paris Ave. N.)
• An existing gas line may need relocating (along Paris Ave. N. — 62^' to Upper 61st)
OPTION 3 (Combination of 1 & 2)
• Removal of numerous trees:
• Approximately 23 trees on County property (16 south of 62nd Street N. & 7
west of Paris Avenue N.)
• Approximately 5 trees on City property (1 adjacent to residence on south side
of 62nd Street N., 4 along west side of Paris Avenue N. near County access
road entrance)
• Road closure /disruption starting at residence on south side of 62nd Street N. around
comer onto Paris Avenue N. for a couple hundred feet, affecting access. Replace
existing roadway section in kind, or upgrade to 28' wide with concrete cb. & gut..?
• Overhead utility lines /poles need relocating (along Paris Ave N. S/o of Upper 61st St.
N)
• Crossing under overhead power lines (adjacent to residence on 62nd Street N.).
Some issues are common to all three Options and include:
• South of the County's gravel access off Paris Avenue N., all existing trees and
vegetation will be removed for pond grading. The County does have a fairly
comprehensive landscaping plan to account for all the trees and vegetation being
removed.

• The proposed storm sewer realignment will cross existing utilities, including a gas
line, water main, sanitary sewer, and overhead power lines.
A catch basin will be included at the southwest comer of 62nd St. N. and Paris Ave.
N. that the City can connect to in the future to help alleviate drainage issues at 62nd
St. N. and Beach Road.
• The trunk storm sewer will be owned and maintained by the City. As such,
easements will need to be granted by the County for all areas not in the City of Oak
Parts Heights right -of -way.
The City Council should decide which OPTION they prefer, so that the project can move
forward. The County hopes to advertise for bids in mid -July so they can get grading and utility
improvements completed this year (to coordinate with the building construction).
Other Campus Exwnsion Issues:
There are a number of other issues related to the overall County Government Center Expansion
project that have some affect on the City of Oak Park Heights. These items include, but are not
limited to the following:
• Easements needed (public storm sewer and water main)
• Easements to be vacated (along Panama for street, storm sewer, or water main). An
ALTA survey should be provided to verify existing easements.
• Water system (has been modeled, is o.k./better.) This includes relocating the existing
Pressure Reducing Station from south of the Gov't. Center to the east side. Plans
need to be included for this work.
• Temporary Parking Lots south of Gov't Center (these will be paved to reduce
dusUsediment impacts)
• Internal Pathways (currently dead -end at existing residence south of Law Enforcement
Center)
• Signal at 62nd Street N. and Osgood Avenue N. — additional signage needed for Gov't
Center Campus at this intersection?
• Lighting on north and east sides of campus (facing OPH residents)
