I. CONDITIONAL USE PERMIT FOR:

All uses shall be subject to the following conditions and /or
restrictions imposed by the City Council of the City of Oak Park
Heights.
A. Site to be used for bus maintenance, repair and storage (includes
wash bay). Outside use or storage of buses is subject to this conditional
use permit.
B. Conditional use permit has been granted by the City Council on May
25, 1999, subject to the following conditions:
1. Not more than 120 buses will be stored on the
site.
2. Additional plantings shall be provided in the
the property along the south property line, subject
approval of the City Staff and Arborist.
3. The existing vegetation along the southwest property line is to be
moved, as indicated on the site plan, to provide traffic visibility for the
southeast corner of

abutting property.

5. Modification of existing stormwater catch basins to minimize
sedimentation loading shall be subject to the review and approval of the DNR.
6. All parking and storage areas shall be surfaced with bituminous
material and concrete curbing with stormwater retention systems being
installed by the applicant prior to commencement of operations on the site.
7. A revised lighting plan shall be submitted indicating lighting
intensity to the property line, the same being subject to the review and
approval of City Staff.
8. MPCA requirements regarding liquid bulk storage and waste handling
shall be complied with.
9. The applicant receive EPA approval of a hazardous waste generator
permit prior to commencing operations on the site with a copy being provided
to the City.
10. All grading and drainage issues shall be subject to the review and
approval of the City Engineer.
11. Applicant shall resolve all issues relating to any access permits
as may be required by Washington County Department of Public Works.
12. Additional plantings shall be provided along the north proper._
line, adjacent to the bus parking area, subject to the approval of the, City
Staff and Arborist.
13. Block heaters and heater plugs shall be installed on all buses
operated out of the facility at 5302 Stagecoach Trail before commencement of
operations. .
14. An operations plan shall be developed and enforced, subject to the
review and approval of City Staff, requiring that all buses shall be backed
into their respective parking spaces at the end of the days operation.
15. A plan for the hours of operation shall be developed by the
applicant, subject to the review and approval of City Staff.
16. Annual review is hereby imposed as a condition of this permit.
This permit shall be reviewed on or about June 1, of each year and may be
amended or altered in the discretion of the City Council.
17. All additional fill that has been added to the property to" the
south in the form of a berm and to the west towards the pond shall be removed
by the applicant as follows:

a. To the south, if desired by that property owner, with a retaining
all installed at applicant's expense in lieu of the berm; r �
b. To the west by removal of the fill back to the original`'west
property line plus an additional 10 feet to act as a buffer.

Parcel 1:
All that part of the NE 1/4 of the SW 1/4 of Section 3,
Township 29, Range 20, contained within the following
bounds, to -wit:
Beginning at a point 3001 West of a stake which is
80 rods South of the center of said Section 3, and
running thence West 24 rods and 3 feet; thence South
21 rods and 9.9 feet to the place of beginning,
exceptin therefrom the South 150 feet thereof.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION DETERMINING FINDINGS OF FACT
AFFECTING THE APPLICATION BY
RYDER STUDENT TRANSPORTATION SERVICES, INC. FOR A
CONDITIONAL USE PERMIT AND ISSUING A CONDITIONAL USE
PERMIT WITH CONDITIONS IMPOSED
WHEREAS, the City Council had directed the Planning
Commission to conduct a public hearing on the application of the
Ryder Student Transportation services for a conditional use
permit; and,
WHEREAS, said public hearing was duly conducted offering
the public and all interested persons the opportunity to be heard
with regard to the application; and,
WHEREAS, the Planning Commission has had the benefit of
the review of City staff, the public comment, and it has further
reviewed all the files and records within these proceedings;and,
WHEREAS, the Planning Commission has made it's findings
of fact and issued it's recommendation to the City Council.
NOW, THEREFORE, the City Council of the City of Oak Park
Heights does herewith make the following:
FINDINGS OF FACT
1. That in considering issuance of a CUP it is
appropriate to also consider the provisions of Section 401.03.A.7
of the Zoning Ordinance. That as it affects the same, the City
Council makes the following findings:
a. Relationship to specific policies and
provisions of the Municipal Comprehensive Plan.
Finding:
The subject property is designated for highway
business /warehousing industrial uses by the comprehensive plan. The
comprehensive plan anticipates redevelopment of this area with
business and light industrial uses.
b. Conformity with the present and future land use
in the area.

Finding:
The subject parcel is surrounded by the
following uses:
North: Residential; zoned "R -2" district; Guided
Residential.
East: Institutional (prison); City of Bayport
South: Residential; Zoned "I" District; guided industrial
West: Institutional(prison); Zoned "O" District; guided
institutional.
The exsisting vegitation on the site will
buffer the proposed use to the residential uses to the north and
south. The storage area is at least 58 feet from the property line
of the south residence and over 250 feet from any existing
residential use to the north. The proposed use is considered to be
compatable with the adjacent residential uses.
c. Environmental issues and geographic area

Finding: 1. A storm water pollution prevention plan
is required to be approved by the MPCA upon issuance of a CUP.
2. The applicant has discussed storm water
sedimentation issues with the Minnesota DNR. Based on these
discussions, the applicant will modify existing storm water catch
basins to minimize sedimentation loading. These improvements will
be subject to the review and approval of the DNR.
3. The applicant must apply for a Hazardous
Waste Generator permit for the handling of motor oils, gasoline,
ect, from the EPA following approval of the CUP.
4. The applicant has provided testing
documentation completed by OSHA from an existing facility that
indicates no significant air pollution.
5. The applicant has provided a video
documenting noise levels at an existing facility as comparable or
less than noise levels of general traffic.
d. Whether the use will tend to or actually
depreciate the area in which it is proposed.
Finding:
As .a planned industrial area, the proposed use
is not expected to depreciate area property values.
e. The impact on the character of the surrounding
area.
Finding: Industial use of the subject parcel is
anticipated by the comprehensive plan. The existing and proposed
vegitation on the site will serve to mitigate any negative impacts

to existing development. As such no negative impact to the
surrounding area is anticipated.
f. The demonstrated need for such use.
Finding:
The space needed to store 120 buses
necessitates outdoor storage.
g. Traffic generation by the use in relation to
the capabilities of streets serving the property.
Finding:
The applicant has submitted a traffic analysis
regarding the impact of the proposed bus facility to Stagecoach
Trail. The study concludes the Stagecoach Trail will continue to
function at an "A" classification level with the additional traffic
of the bus facility based on present and projected 2020 traffic
volumes. The only other significant issue is access to Stagecoach
Trail from the abutting property to the south being visually
impeded by existing vegitation. As noted above the applicant will
remove existing vegitation to alleviate the situation. The traffic
study is subject to the review and approval of the City Engineer.
h. The impact upon existing public services and
facilities, including parks, school streets and utilities, and the
City's service capacity.
Finding:
The proposed use will not negatively impact
City service capabilities.

i. The proposed use conformance with all
performance standards contained within the Oak Park Heights Zoning
Code.
Finding:
These factors are evaluated in the Planners
Report of 8 April 1999 which is adopted by reference herein.
NOW, THEREFORE, the City Council for the City of Oak Park
Heights makes the following determination:
The City Council does hereby approve the conditional use
permit for Ryder Student Transportation Services Inc., to permit
and allow the bus storage facility subject to the following
conditions:
1. Not more than 120 buses will be stored on the site.
2. Additional plantings shall be provided in the
southeast corner of the property along the south property line,
subject to the review and approval of the City Staff and Arborist.
3. The existing vegitation along the southwest property
line is to be removed, as indicated on the site plan, to'provide
