HomeMy WebLinkAbout2002-11-26 CC ResolutionA RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY VALLEY SENIOR SERVICES ALLIANCE (VSSA) FOR CONCEPT PLAN APPROVAL FOR THAT AREA SOUTH OF NORWICH PARKWAY AND NOLAN AVENUE WITHIN THE McKEANS WEST DEVELOPMENT OF BOUTWELLS LANDING BE APPROVED WITH CONDITIONS WHEREAS, the City of 0ak Park Heights has received a request from Valley Senior Services Alliance for concept plan approval for that 36 acre area south of Norwich Parkway and Nolan Avenue within the McKeans West development of Boutwells Landing; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the application be approved with conditions. The City Council of the City of 0ak Park Heights makes the following findings of fact: follows, to wit: and and RESOLUTION NO. OF THE CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B 3. Valley Senior Services Alliance has proposed a 152 unit development requiring planned unit development concept plan approval; and 4. A rezoning from 0, Open Space to PUD, Planned Unit Development District shall be required for the subject property as part of the general plan of development review; and 5. The City staff prepared a memorandum dated October 10, 2002 reviewing the request; and 6. The memorandum dated October 10, 2002 recommended that the request be approved with conditions; and 7. The Planning Commission held a public hearing at their October 10, 2002 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Valley Senior Services Alliance for concept plan approval for that 36 acre area south of Norwich Parkway and Nolan Avenue within the McKeans West development of Boutwells Landing; and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights subject to the following conditions: 1. The subject area is to be rezoned from 0, Open Space Conservation to PUD, Planned Unit Development as part of the general plan of development approval. 2. The applicants shall submit a preliminary /final plat for approval as part of the general plan of development process. 3. The general plan of development will address relocation of the historic school and construction of a church within the development. The buildings would need to be compliant with Uniform Building Code standards and all accessibility requirements based upon proposed occupancy. 4. The City Engineer shall review and approve street and right-of-way widths and placement for the proposed development as part of the preliminary plat approval. The Police Chief and Fire Chief should comment on any safety vehicle access issues of the public roadways and private driveway access. 5. All street, utility and drainage easements dedicated for the project shall be subject to review and approval of the City Engineer. 6. The curb line of Nolan Parkway should be placed at least 10 feet from the east property line adjacent to Baytown Township. The issues related to Baytown Township access and preservation of trees shall be addressed as part of general plan of development review. 7. All buildings in the development shall maintain at least a 20 foot setback from the curb line of the street network. 2 8. The driveway for the 10 unit dwelling and parking spaces shall maintain at least a 10 foot setback from property lines or public sidewalks within the development. 9. The applicants shall submit detailed plans, as required by the City, as part of the general plan of development review in compliance with all requirements of the Zoning Ordinance and Subdivision Ordinance. 10. Detailed grading and drainage plans, as required by the City Engineer, shall be submitted as part of general plan of development review, subject to review and approval of the City Engineer and applicable watershed authority. 11. Detailed utility plans, as required by the City Engineer, shall be submitted subject to review and approval of the City Engineer. 12. The Parks Commission and City Council should comment on specific trail and sidewalk locations and dimensions. Revised plans based upon those recommendations shall be incorporated as part of the general plan of development plans. 13. VSSA shall be required to dedicate all necessary right-of-way and easements as required by the City and approved by the City Council. 14. The applicant enter into a development contract with the City specifying conditions of approval subject to review and approval of the City Attorney and City Council. 2002. Limitation on General Concept Plan Approval Unless a General Plan of Development covering the area designated in the General Concept Plan as the first stage of the PUD has been filed within twelve (12) months from the date Council grants General Concept Plan approval, or in any case where the applicant fails to file General Plan of Development State and Final Plans and to proceed with development in accordance with the provisions of this Ordinance and of an approved General Concept Plan, the approval may be revoked by Council action. 1/
