PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY ATTRACTA SIGN, REPRESENTING ANDERSON WINDOWS FOR PROPERTY LOCATED AT OSGOOD AVENUE AND HIGHWAY 36, KNOWN AS THE LOWER ST. CROIX MALL FOR A PLANNED UNIT DEVELOPMENT /CONDITIONAL USE PERMIT AND DESIGN GUIDELINES REVIEW FOR A CHANGE IN SIGNAGE AND AWNINGS BE APPROVED WITH CONDITIONS. WHEREAS, the City of Oak Park Heights has received a request for a Planned Unit Development /Conditional Use Permit and Design Guidelines review to allow for a change in signage and awnings at the Lower St. Croix Mall located at Osgood Avenue and Highway 36, after conducting a public hearing relative thereto the Planning Commission of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The St. Croix Mall property has been granted Planned Unit Development /Conditional Use Permit approvals under the B -2, General Business District; and 4. Any revisions to the signage plan for the St. Croix Mall are subject to an amended PUD /CUP in accordance with the Zoning Ordinance and the original mall approvals; and 5. Changes to the awnings and facade of the lower mall are subject to Design Guidelines review and approval; and 6. City staff prepared a planning report dated October 3, 2001 reviewing the request for the amended PUD /CUP and Design Guidelines approval; and 7. Said report recommended approval of the sign package and building fagade improvements subject to the fulfillment of previous conditions; and 8. The Planning Commission held the public hearing at their October 11, 2001 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendations: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The Planned Unit Development /Conditional Use Permit and Design Guidelines application submitted by Attracta Sign, representing Andersen Windows to allow for a change in signage and awnings at the Lower St. Croix Mall, affecting the real property as follows: SEE ATTACHMENT A Be and the same is hereby recommended to the City Council of the City of Oak Park Heights for approval with conditions as follows: 1. The Planning Commission/City Council should consider the acceptability for two signs each at Carbone's Pizza and Subway. 2. The applicant should provide samples of the canvas awning material and building paint colors for Planning Commission and City Council review. 3. Further changes to tenant signage or the addition of signage above tenant spaces at the lower mall may be approved subject to review of a sign permit by the Building Official, and conformance with the provisions of Section 401.15.G of the Zoning Ordinance.
