Dear Mr. Albrightson:
In reviewing your request for a subdivision waiver on Lot 14 of Block 1, St.
Croix Mall PUD, we have found that this lot split is in accordance with Section
402.01, Subdivision G, part (a) of the Oak Park Height's Subdivision Ordinance.
This section states that the City Council may exempt the subdivider from complying
with any procedural requirements of this Ordinance deemed inappropriate. This
would allow the lot split to be approved without a public hearing but would
require the approval of the City Council.
A recommendation we have regarding the lot split would be to identify "Parcel 2"
as Lot 10, Block 2. This would provide for greater clarity and consistency among
the various lots within the plat. This should be pursued before the County Survey
begins recording the plat. If the County Surveyor has already recorded the plat,
the lot split will require a simple subdivision and survey designating the subject
property as Lot 10, Block 2, St. Croix Mall PUD.
