The resolution was specific to a conditional use permit for storage areas arid not for pwking. Section 401.1 .l- of the Zoning Ordinance states that concrete curb and gutter is required for "open, off street parking." It does not require storage areas to be provided with a concrete curb. While both of the storage areas will from time to time be used to park vehicles, the purpose of these lots are riot - for public parking. The intent of the Ordinance is to require parking lots to be surrounded with concrete curb to protect the paving edge and to provide appropriate stormwater drainage, With a storage area that does not see daily in and out traffic, curbs are not required if storrnwater drainage is addressed in other ways. While it is my opinion that the City will not need to give itself a variance for the storage areas, the Ordinance could be clarified on this issue. For instance, the language could state that storage areas would not be subject to curbing requirements. If that language is too broad, it could be that storage areas for police security and public works storage could be exeryipt. Please let me know if you need additional information for clarification on this issue. Page 6 of 46 S7 JORGENSON CONSTRUCTION INC. 5HEET_ .......... 0F.._. ..... -- ESTI ATE SHEET SEC.
